The American public is becoming fed up with “sneak” provisions tacked onto largely unrelated bills that are likely to pass. A glaring recent example was tacking onto the Healthcare bill a complete change to student loans. Often the “sneak” provision is so buried that hardly anyone is aware of it.
The Wall Street Reform and Consumer Protection Act of 2009 (H.R. 4173), recently passed in the House of Representatives, includes language going far beyond finance inserted by Congressman Henry Waxman (D-CA). This language could be used for an end run around the Dietary Supplement Health and Education Act (DSHEA), the legislation that governs dietary supplement regulation by the FDA.
The Senate is expected to vote on its finance “reform” bill as early as this weekend. We need your help to ensure that it is not amended to include a similar provision going far beyond finance that could be used against supplements. Please take action now. TAKE ACTION
Congressman Waxman is well known as an opponent of the dietary supplement industry. This is somewhat ironic: his district includes Hollywood and presumably many of his closest supporters are health store shoppers and supplement users. Most of these people simply don’t know what Waxman is doing in this area.
This powerful Congressman, chair of the House Energy and Commerce Committee (which includes health as a subcommittee), would appear to want supplements regulated like drugs, a step that would effectively eliminate them. He is determined and has stated: “One enduring truth about Washington is that no issue is ever settled for good.”
ANH-USA has been on alert to see how Waxman would use his committee chairmanship to strike at DSHEA. He is very clever and we knew a covert attack was a possibility.
A direct attack on supplements would take the form of an amendment to DSHEA, since that legislation governs FDA regulation of supplements. In this case, Waxman has left DSHEA alone, and has instead inserted language in the Wall St. “reform” bill that gives the Federal Trade Commission (FTC) important new powers that could be used to circumvent key supplement protections in DSHEA. TAKE ACTION
To see how this would work, let’s see how the FTC operates today. Its chief mission is to combat commercial fraud. It has full authority to pursue companies making fraudulent claims. But the FTC can’t go beyond that, can’t set other regulatory requirements, without advance approval of Congress. The FTC once had this regulatory “rule-making” authority. It lost it in the 1980’s because Congress thought the Agency was abusing it.
At the present time, if the FTC moves against a dietary supplement company for false or misleading advertising, the FTC typically requires the company, as part of a consent decree agreed to by both parties, to back up its claims by undertaking at least two random controlled human trials. This is done on a case-by-case basis and is legal because the targeted company has agreed to it.
If the FTC had general rulemaking authority, which Waxman’s language reinstates, the Agency would be expected to create a new legal requirement for all supplement companies. Such companies would have to perform at least two of these human studies before making any claims for their products.
Why should we care whether supplement companies are required to perform two random controlled human trials for each product? Because such trials take a long time and would be beyond the financial means of most supplement companies. Even if the companies could find the money, the FTC could require more and more costly versions of these studies, or more of these studies. At each stage, fewer supplements would be available, and those available would cost more and more, until they became as costly as drugs.TAKE ACTION
Supplements are not drugs. In most cases, drugs are non-natural and therefore patentable substances. Why patentable? Because no company will spend a billion dollars on studies and FDA approval trials without the monopoly provided by the patent. To insist that supplements be treated like drugs is really to sound the death knell for the supplement industry, something that drug companies would be delighted to see, because they know that supplements are their chief potential competition, are often more effective than drugs, are often less toxic, and are always much less expensive.
Supplements are already regulated by the FDA under DSHEA. If the Waxman provision is included in the final Wall St “reform” bill, the FTC will gain the power to override the limited protections for supplements that already exist under DSHEA. The FDA would still have to respect DSHEA, but the FTC would not be so constrained.
Five unelected FTC commissioners would issue binding regulations in a wide range of areas, including the regulation of dietary supplements. And companies that did not comply with the new FTC rules could effectively be put out of business.
According to renowned constitutional attorney Jonathan Emord, “The provision removing the ban on FTC rulemaking without Congressional preapproval contained in H.R. 4173 invites the very same irresponsible over-regulation of the commercial marketplace that led Congress to enact the ban in the 1980s. FTC has no shortage of power to regulate deceptive advertising; this bill gives it far more discretionary power than it needs, inviting greater abuse and mischief from an agency that suffers virtually no check on its discretion.”
The bottom line is that FTC would be given power to regulate areas they don’t understand, and their first order of business would likely be to regulate supplements, an area far outside their area of expertise.
The Senate Wall St “reform” bill, the Restoring American Financial Stability Act of 2010 (S. 3217), doesn’t contain the Waxman provision yet. But we know that Senator Rockefeller (D-WV) may offer an amendment including Waxman’s language. Please help us stop this. Please take action now to help us maintain access to low cost, high quality supplements. Tell your senators not to support any amendments that give FTC unchecked power to over-regulate areas they don’t understand, including dietary supplements.

I am a user of Goldenseal root (in capsule form) for preventing colds or flu when I feel symptoms coming on. I take a little out of a 500mg capsule and put it in water or apple juice and drink it. I also take two 1000mg vitamin C capsules. That usually dries up the symptoms which may include a light sore throat, feeling cold, nasal congestion, etc. If I need more, I take more after about an hour. I may take more after another couple of hours, if necessary. I keep the Goldenseal root capsules in my purse pill case and also the vitamin C capsules. I used to work in a health food store and a customer told me about Goldenseal about thirty years ago. I have avoided colds and the flu so many times. As a child, I had many colds that turned into bronchitis and missed at least 2 years of elementary school with these bouts. Now I rarely actually get down with any virus at all!
I wrote to the CDC and NIH about my method of avoiding colds and the flu thinking they would be overjoyed to hear that there was actually a way of avoiding these illnesses for the most part and that they would want to use it to reduce absenteeism for workers and others and thus help the economy. No such luck! Also, I said I wanted them to test Goldenseal Root to be sure there were no negative interactions with other real drugs or herbs that people might be taking. The suggestion of NIH was that I would have to hire my own scientist to do this testing! I couldn’t believe it! Even to this day, when I presented my method of avoiding colds and flu via a letter to our current Secretary of Health, her assistant wrote a letter back to me saying that the FDA will not allow any instructions to the public about avoiding the flu other than those we often heard during the swine flu scare: Wash your hands often, sneeze into your elbow, stay home if ill, etc. They said that if something were not approved by the FDA, it could not be recommended. Well, I guess you already know that…but I wish some entity (other than the drug companies) would test the supplements we take so that we would know that there would be no adverse reactions. At this point, I will continue to take my Goldenseal root and vitamin C at the first sign of a cold or the flu. I am so surprised that Congressman Waxman would want to restrict supplements, since I favor his point of view on just about every other issue.

I want free access to vitamins, minerals, and herbs. If it is going to be so hard to have affordable health coverage, the least we constituents should be able to have is some way to take preventative measures so we don’t have to develop those expensive diseases.

Non medical and non scientists should not be allowed to dictate to the consumer when and if they can use supplements to enhance their quality of life. Basically, I am alive, healthy, disease free, “conditions of aging” free, physically fit, and look 15 years younger than I am chronologically due to supplements and BHRT, diet and exercise. NO government agency should have the power to stop this by getting rid of supplements. This just makes the agency a henchman of the pharmaceutical industry and doctors who are losing money if their “:”bread and butter” diseases are none existent:cardiovascular disease, aging, high blood pressure, diabetes. The preventative supplemnents in these areas are not harmfula nd are re effective than drugs.

For the economy and for our personal freedom, it is mandatory that we remain free to choose. I am shocked and surprised that Sen. Waxman would try to sneak through a provision against supplements. For people like me, with chronic illness as well as multiple allergies to multiple pharmaceuticals, supplements are almost the only help out there. Why in the name of common sense do we need to keep “feeding the monster kitty” that is BigPharma?
They are trying to make us sick with toxic waste under the labeling of climate change prevention so what better way to continue the job of making us dependent on pharmaceuticals till death do us part? This is more than mischief; all of it boils down to crimes against humanity! Vote him out and investigate his involvement in the atrocities. 1. Specifically identify supplements as the issue in the first paragraph.
2. In connection with human trials, point out that there are typically many, sometimes thousands of published peer reviewed scientific studies in the literature before a supplement is ever marketed.
I am a consumer of supplements and I resent the government making it harder or impossible for me to get them. I do research myself on any that I take and buy from companies that are well known. I think my good health is resposible in many ways because I do take them.
Please do not put such regulations on our supplements.

My GOD!!! What next? They tried this back in 1992 and we stopped them. We’ll do it again! Do not take away access of vitamins and supplements by the people. I work in the field of Integrative Healthcare, as a massage therapist and soon also as an Acupuncture Physician. We see many patients that cannot or will not take Pharmaceuticals and choose to take supplements of their choice. As a person who had Chronic Fatigue and Fibromyalgia – without my supplements, I would have never gotten better. I had to take several herbs and vitamins per day – but I got well and have my life back. I see patients w/ these ailments taking Western drugs and falling apart from the HORRIFIC SIDE EFFECTS!!! Not to mention narcotic addiction for the pain of Fibro. The FTC needs to do some soul searching before they jump into the fire on this one. Leave well enough alone. Don’t take away peoples rights in regards to their health. As for Waxman – his political life should be over!!!
Senator Waxman and all other senators xontemplating a yes vote, I would like you to walk in my shoes and the shoes of thousands of other American citizens fighting cancr who have relied on supplements to sustain life. I am fighting pancreatic cancer and with the help of Dr Nicholas Gonzalz am living beyond the time I was told I had left by the doctors who diagnosed it in July 2009. I have dependents for whom I am prime caregiver and am fighting hard to continue that role. For most cancer patients hope is key and from discussions during chemotherapy sessions with other patients, we strive to eat a healthy diet, take supplements to help boost our immune systems because without a pro-active lifestyle, we would be forced to give up.
It is easy for those in legislature to form opinions but how many of you seek information from those who are affected by the laws passed. ObamaCare is a classic example… it was not thought out or tested. it was passed for the ego of a few. I wish that our government would start representing the people rather than than the government legislature.

There are many thousands of studies documenting the safety and effectiveness of many types of supplements in preventing and improving chronic health conditions. There is also documentation that pharmaceuticals are responsible for as many adverse effects, hospitalizations and deaths as for cancer or heart conditions. There is no similar documentation of widespread problems with natural supplements, which are documented by Gov’t studies to be beneficial. Focus should be on the pharmaceuticals, where most of the documented harm is occurring, not on safe and effective supplements. There is no way that the Federal Gov’t has the knowledge or resources to regulate what is clearly more beneficial than harmful. Leave supplements alone.

This isn’t a vitamin/supplement issue. It’s a truth in advertising issue.
The problem is that a lot of manufacturers say their products do things that the manufacturers have no proof the products actually DO. No one is regulating supplements or vitamins here, only saying that if you can’t prove a vitamin/supplement does something, you can’t advertise that it does. It seems like the vitamin and supplement industry (or at least those reputable manufacturers/suppliers) ought to be happy about this amendment because it’s directed at rooting out purveyors of snake oils and tonics. Anyone who says their product will do something ought to be able to show some reasonable evidence for that claim. Otherwise, just don’t make the claim and there’s no problem.
The issue here is that the FDA already prevents supplement manufacturers from making any claims about their products, despite real, proven science that documents their effects. The FDA is owned, financed and subsidized by big pharma which doesn’t want us purchasing anything they can’t patent. So this is yet another attempt to tighten the noose around the dietary supplements industry. Do you want to be able to go into any store and purchase Vitamin C caps or Echinacea if you have a cold, then you have an interest in stopping this legislation and others like it. If not, all vitamins and herbs would be unavailable, controlled by pharmaceutical companies who want you to buy their products instead and they would charge a premium for them, as they do now.
My understanding is FTC should not have unlimited power for controlling supplement access by the public. Congressman Waxman, apparently, slipped an antisupplement measure into a Wall Street “Reform” Bill, and it should be removed, nor nothing like it allowed in a similar bill sent to the Senate for passing. I am VERY disappointed in ANF for only bringing this provision to our attention now. The House bill passed months ago if I remember. Where were ANF and other organizations then to alert us and to create the movement to stop this then? As a result I’m not sure I trust ANF’s characterization of this provision and it’s potential impact on supplements.
Waxman yes is a known skeptic about supplements, but the shrill attacks on him in these comments are way over the top. He more than any other legislator has fought big tobacco for decades and as a result has probably saved more lives than anyone in America.

This is an outrage! I was raised with supplements and because of them my mother’s health was restored when the western medical profession and drug pushers (pharmacueticals) could do little to help her. I am and always will be a firm believer in SELF HEALTH and SELF HEALING, as well as being proactive with taking care of one’s self. I do not want the government or any instiution to intervene or regulate in what is my GOD GIVEN RIGHT– to take care of myself. I know best what is best for me. 2.5 years ago the FTC attacked over 130 nutrition companies for “false and misleading” information on their websites related to alternative cancer treatments. Eventually all capitulated to FTC demands–all but one. Daniel Chapter One, a Christian health ministry which uses product sales to fund their work, fought the FTC in the administrative star chamber “court,” and lost its bid to continue providing information on alternatives to phamaceutical drugs. Begining in April, DC1 is under a “cease and desist” order (for 20 years!) forbiding them to provide ANY information about alternative treatments–they cannot even recommend WATER for dehydration (FDA rules stipulate this type of advice magically transforms common substances into “drugs.” For example, vitamin C becomes a “drug” if used to treat scurvey!). DC1 is appealing to a “real” court of law. They are currently the “spear tip” fighting for our health freedom. Look into this and spread the word!

We should understand the importance of supplements more. I do not know what this bill entails but I do think the FDA needs to start doing it’s job. Food is medicine and it should be taken more seriously. Drug companies simply try to mimic mother nature anyway. Aspirin comes from the herb meadowsweet. We should start to look to proper sources. As of now we are probably only insulting God by ignoring or trying to improve upon his work in a drug lab.

Along with being totally against the Waxman amendment, we are opposed to the punitive individual insurance mandate, which is nothing more than bailout for the predatory insurance and pharmaceutical cartels. Reverse the horrific insurance mandate, and allow individual states to establish a Single Payer Medicare for All system.
At this juncture in our nation’s history which the big Pharma and for-profit health insurance industries are almost in total control of our health, we need to make sure to have ‘access’ to alternative health care, that includes vitamin supplement intake to maintain good health. From a recent direct personal experience with a run in with a doctor at my local VA hospital, he insisted that I take this horrible toxic drug called SIMVASTATIN to help lower my cholesterol level. Instead of following his alophathic toxic regime, for the last month, I took the initiative to double up on my healthy diet/lifestyle change, which included daily exercise, taking different types of herbal vitamins and supplements, I managed to lowered my cholesterol level substantially in less than 5 weeks. When this doctor called me recently to informed me of the positive result from the blood test, I then remined him that I never took anything he prescribed for me, instead, I reliied solely on alternative medical approach. From the tune of his response, he was NOT HAPPY AT ALL! I DON’T THINK THESE DOCTORS KNOW MUCH ABOUT ANYTHING OTHER THAN WHAT THEY ARE BEING TOLD TO PUSH FOR THE BIG PHARMA. We respectfully demand the removal from H.R. 4173 – the “Wall Street Reform And Consumer Protection Act of 2009″ – any and all language which would confer or imply additional powers or enforcement to the FTC, regarding vitamins and nutritional supplements. This is to include any associated advertising, educational materials, or user reports of effectiveness.
You and the pharmaceutical lobbyists tried to Shanghi the nutritional supplement industry though the FDA, almost 20 years ago. The political backlash brought the DSHEA legislation of 1994. We are sick of the underhanded tactics, and we will not stand for it this time, either.
It would be interesting to speculate if ‘Big Pharma” has the ability (and the willingness) to insulate their purchased legislators from all economic and political repercussions which are sure to ensue.

I am against it and I feel as an American I am capable of making my own choices and decisions and I am for pro freedom and pro choice to choose to continue to take supplements as I deem necessary. Some very good ideas well worth mentioning again by other posters here are “maybe we should make it illegal for our elected officials to accept lobbyists money. Lobbying should be illegal. With the ability to communicate through the internet (blogs, email, facebook and forums) our elected officials can take the issues to the people directly and we can respond directly, so that we the people are the ones who will inform our representatives how to decide. There is no way that the Federal Gov’t has the knowledge or resources to regulate what is clearly more beneficial than harmful. Leave supplements alone. The FTC shouldn’t have the unchecked power to over-regulate areas they don’t understand, including dietary supplements. Our elected officials should serve the people who put you there and do the work that really needs to be done and stop taking bribes and kissin ass!!!! Please do no interfere with our freedom of choice. There are many more causes that need the attention of our elected officials. This is not one of them”. With that being said it is definitely imperative that Waxman, the FTC nor the big Pharma and for-profit health insurance industries should be able to benefit and profit off the successful passing of this bill. Decision NO!!!!!!!!!!!!!. not now….not ever.
Alcohol is the drug of choice for most people, and it is a drug. Ofttimes named the “grease” of society, an informed individual is more prone to land in spots where it is served up. An educated individual is as well more conscious of the pressures to deliver the goods in our culture, and the ensuing hope to unwind from that pressure. Most people have no trouble with this drug, but the problem people impart a horrific trail of wreckage.
Here’s the thing. I’m a Certified Natural Health Professional. I interact with A LOT of my colleagues. Taking away supplements would delight big pharma, shorten our lives, cull the population and create lots of treatment and drug money for allopathic medicine.
HOWEVER, the Naturopathic world operates separately. We are all independent of each other. And that hurts us. The Alliance for Natrual Health is a great organization. We need to keep moving toward that. Over a hundred years ago, Doctors were largely independent too. If you had a condition, you could go to 10 different country doctors and get 10 different type of treatment. They banned together, created rules and protocols. This was done to prevent chaos and to assure that people got consistent treatment that was scientifically proved, tested and up to date. It was a good idea at the time. However, they got ultra powerful, egotistical, self-serving and science made huge advances in drug technology which gave them even more power over us! The old remedies died off in favor of profitable drugs and surgery and the whole system that supposed to protect us became a deadly monster!
What some well meaning law makers and many others under the influence of powerful lobbyists THINK they are doing is trying to undo the chaos THEY think they see in the naturopathic health world. Just like 100 yrs ago, TODAY you can go to 10 different natural health practitioners and get 10 different opinions about what you should do. You can be sold on expensive treatments that have not been tested or proved, supplements that may or may not be appropriate and perhaps delay some medical intervention that may be appropriate. That’s how they see it. What the challenge is to all of us in the Naturopathic world is to ban together agree on accepted treatments, streamline what we do so we can become more of a cohesive group that shows organization and professionalism. However, we have to learn from the past and not let it get to our heads!! Not become the monster even though our power may tempt us…we have to resist. That’s hard for even the most well-meaning people…not to cave in to the power and the money and glitz and glam like big pharma offers doctors. When we can get to that point of being able to handle that power, it will be given to us….as NOT by the law makers or the Senators. It will come from somewhere much more powerful than that!! Call it God, the Universe or the Natural Order of things… however you see it. We’ve got to not only fight the demons that we are living with now, but earn our place in heaven at the same time.

This is a highly urgent post that I have to get out fast because our health freedom as we know it is in jeopardy. There is a bill that was sneaked through the House while everyone else was worrying about the economy that has the power to destroy all organic farms, natural products, healing herbs, nutritious fruits and even our vegetables and other health supplements.
I will give you an overview of this dire situation, but I want you to take action and flood the Congress with petitions to stop this injustice to our health freedoms. It is not what you think. I am not talking about the massive health care overhaul. I am talking about H.R. Bill 2749 and ultimately the devastating Codex Alimentarius. The one power of the WTO or World Trade Organization and they want to kill all of our healthy foods with radiation and pesticides, etc.
They want to take away all of our natural healing vitamins, minerals, enzymes, amino acids, hormones, herbs, healing fruits and vegetables so there will be “ZERO” competition to Big Pharma. This could be the end of our natural health healing freedoms as we know it and the mass influx of sickness and death and drug-ridden stench and sewage. This Bill was rammed through the House and is headed for the Senate if we do not stop it now! We must stop it now!’
This is only one battle won and there will be more to come in the organics and supplements war.
We must stay vigilant. Stand up people and protect your right to health freedoms.
