A wide variety of organizations, working together with ANH-USA, have swung into action to stop John McCain’s new bill that threatens dietary supplements. Already thousands of messages are on their way to Capitol Hill in protest. Please be sure that your message is among them. If you have not already done so, please take action now.
As we told you last week, Senator John McCain (R-AZ) and Senator Byron Dorgan (D-ND) have cosponsored a new bill misleadingly called The
Dietary Supplement Safety Act (DSSA). DSSA would repeal key sections of the Dietary Supplement Health and Education Act (DSHEA), signed into law by then-President Clinton.
DSHEA protects supplements 1) if they are food products that have been in the food supply and not chemically altered or 2) if they were sold as supplements prior to 1994, the year that DSHEA was passed. If a supplement fits one of these two descriptions, the Food and Drug Administration (FDA) cannot arbitrarily ban it or reclassify it as a drug. DSHEA provides the framework for effective regulation of dietary supplements by the FDA.
The Dietary Supplement Safety Act (DSSA) would eliminate the supplement protections contained in DSHEA and allow the Food and Drug Administration (FDA) arbitrary authority to draw up a list of what supplements can be sold and at what potency levels. Europe is currently limiting both supplements and potencies to ridiculous levels. If DSSA passes, the FDA, beholden as it is to drug interests, would move to do the same in the US.
Please take action now.
The purported emergency giving rise to DSSA is illegal steroid use by athletes. The bill is supported by the US Anti-Doping Agency (USADA) which is funded by major league sports teams including baseball, football and others. Baseball commissioner Bud Selig has urged its adoption. In his comments, Senator McCain cited six NFL players recently suspended for testing positive for banned substances and allegedly exposed to these substances through dietary supplements.
The FDA currently has complete and total authority to address illegal steroids and, more broadly, to regulate dietary supplements. If the FDA were policing rogue products adulterated with steroids as current law requires, the NFL violations would not have happened.
DSSA also requires the reporting of even minor adverse events related to supplements. This is in addition to the already existing requirement to report serious adverse events. This will further stack the deck against small supplement companies by creating new, unnecessary, even more cumbersome, and of course very expensive administrative hurdles.
It will also give the FDA, which ignores very large numbers of serious adverse reports involving drugs, including many deaths, more ammunition to use in its capricious war against food supplements.
The likely result: the consolidation of the supplement industry into a few big companies selling many fewer supplements at much lower doses. These large companies would also very likely be owned by drug companies.
The bottom line: our health would be almost completely controlled by the FDA and drug companies.

Natural Products Association executive director John Gay has issued the following statement in response to Senator McCain’s proposed legislation: “Our industry has long supported efforts to remove the relatively few bad actors who market adulterated products. We have advocated for additional enforcement funds for regulators, and for giving regulators additional authority to act. What we cannot support is wholesale changes to a regulatory structure that is working, and could work better if the measures we have supported were adopted. A series of new laws for criminals to ignore is not the answer. Some seek to paint with an awfully broad brush. For example, the idea that the 150 million Americans who use dietary supplements are gambling with their health by shopping at mainstream stores just doesn’t stand up to scrutiny. Hyperbole does not lead to sound policy.”
Council for Responsible Nutrition president Steven Mister offers his comment as well: “Dietary supplements have a very strong safety profile and consumers should continue to feel confident in the supplements that they are taking.”
Senator McCain’s proposed legislation highlights the mindset at the FDA, dubbed the Fear and Denial Administration by Senator Tom Harkin (D-IA). The FDA, which is responsible for guarding the health of American citizens, is hostile to the kind of natural medicine—based on lifestyle choices, nutrition, dietary supplements, and exercise—that is both effective and sustainable.
Senator McCain appears to have been naïvely sold a bill of goods from vested interests. It is clear he does not know that he is being used by these interests in opposition to the wishes of tens of millions of Americans who supplement wisely to maintain optimal health. This is the definition of Fascism, and the money that is generated from such go towards funding their favorite puppets. This has nothing to do with banning steroids, which the alphabet soup of the USA can easily do without this law designed to trick the majority of the USA into giving up their own rights and freedoms. This law attempts to use sports fans displeasure with cheating as a tool to pass a ban on real good natural medicines available to all. Why is it that the pharmaceutical industry is so interested in backing politicians who hunt for oil half way across the world, when there is oil at home, and also ways to make drugs that don’t involve oil? There are even ways to make oil from things like trash and algae. The answer is that synthetic drug manufacture and distribution is heavily reliant on the petrochemical industry that relies on oil. All of this then is a pretext to rob and enslave the middle class and poor, by people who think they are somehow privileged humans.

As it stands now, a ‘supplement’ label may claim, for example, 1000 mg calcium, but there is no regulation or enforcement of that.
Would this bill mean that if the label says, for example, 1000 mg calcium nitrate, that the product has to have that, rather than perhaps half the stated amount?

Why hasn’t there been a congressional investigation of the antics of the FDA and Big Pharma? Are they in bed with the drug companies too? In their efforts to suppress any natural substance that has health benefits the FDA is using tactics that if you or I tried them we’d get a nice long stay in the cooler. But the FDA does it with impunity. Case in point: Greg Caton. Greg was living in Ecuador, not bothering anybody except the US pharmaceutical industry. The FDA duped Interpol into putting Greg on their wanted list, bribed local officials into having him arrested, then while he was awaiting a hearing FDA officials kidnapped him, stuffed him on a commercial airliner flouting a local judge’s order that he was not to be removed, flew him to Miami and put him in a holding facility. What happened to him after that apparently nobody knows. His crime: Making and distributing a cure for cancer that works.

I took “natural” supplements until my tongue turned black, my hair fell out, my liver was
congested, I had to take more supplements to counter the effects of the supplements,
I lost my voice for 3 weeks, I sat on the toilet for days without relief, I contracted a virus
due to a declining immune system, I was hospitalized due to kidney failure, my spouse
left me because I was depressed, I became anxious and was diagnosed with a mental
health illness, I tried to commit suicide, more supplements were given to me and I was
institutionalized for 6 months. Now I just feel “lost”. But I’m sure there is some vitamin
or mineral or other product that can “fix” me.

If the disclaimers for natural supplements were even 1/2 of the disclaimers for pharmaceutical
drugs, supplements would have been outlawed across the board, permanently and completely.

With extremely rare exception (mostly a weight loss or muscle building supplement that is not “natural”), supplements do not cause death, kidney and liver failure, suicidal ideation, depression, hair loss, loss of strength of the immune system, and a myriad of diseases and degeneration.
The real quacks are the ‘prescribers’ and producers of mainstream pharmaceutical drugs while the FDA fully supports their quackery. The FDA dare not put them in the category of any serious risk or harm to those in this country who are seeking assistance with health issues via prescription or over the counter drugs. These companies and doctors just need to make their softly spoken disclaimers and all is “well”.
Notice that as millions of Americans turn more and more to natural supplementation to remedy aches, pains, illness, and to maintain health, the FDA and the drug companies increase their campaigns against this competition. They don’t even have the concern they should be hiding their agenda. The convoluted insulation put forth by the government and mainstream medicine is solidly in tact. Still they perceive a big enough threat to their “industry” from supplements to attack natural supplementation and the doctors and practitioners who offer supplement advice in any way they can. As an aside: Quackwatch.org by the way is not an extensive site put together by one man. Think about it.
This action of McCain’s clearly does nothing more than help Big Pharma and injure the ordinary person who would like to look after their own health issues.

supplements are mostly unregulated for efficacy and safety and are scrutinized only after enough adverse affects are reported. unscrupulous purveyors of useless supplements arise every day to dupe the public in the next, greatest one pill fits all micro nutrient.

Supplements have given me my life back. After doctors told me there was nothing they could do for my chronic pain caused by gastro distress and diarhea, I read about supplements that helped the intestines. After taking them, I am back to normal. No more pain!

Why should the Federal Government even have laws against steroids? Yes, the leagues should have their own rules, and punishments (including fines and bans from games) for violations. Taking steroids for improving athletic performance is cheating, and should be treated by the leagues as cheating. And, if supplements are being used to sidestep this, the leagues should address the problem. If a supplement manufacturer is fraudulently putting steroids into supplements, this should be addressed as fraud and the manufacturer sued (among other sanctions) for this fraud.
However, regulating my access to vitamins is not going to do a thing against professional athletes cheating. I have taken vitamins and minerals since college, with a 4-year break, and only had good results from my vitamins. While off the vitamins, I got noticeably more (and worse) colds and flus than while I was taking the vitamins. And I currently take supplements that help protect the liver (steroids actually ruin the liver). Taking these supplements off the market will not address the problem of athletes cheating in their games–they will just get their steroids illegally, while everyone else will be missing work and getting sick more often.
Reporting even minor incidents and pulling supplements off the market for these incidents makes no sense. Some supplements carry minor incidents as signs that they are working–cleanses always cause possible diarrhea and flu-like symptoms for at least a short time. Also, someone might take a vitamin at the wrong time and be sleepy during the day or awake all night (which simply taking them at a different time would solve the problem). Vitamin pills also carry some risk of minor upset stomach–any pill of the same size carries the exact same risk, because it’s the pill itself and not the contents that are responsible. As for dying from taking vitamins, I feel the greatest risk of dying or serious injury comes from choking on the pill–exactly the same risk a drug pill of the same size and shape carries. Very few actually die from supplements, and most of those misused the supplements (Ephedra, taken before a hot workout, or in patients with very high blood pressure, aggravated the problems).
Unlike the double- or triple-digit numbers of deaths from supplements in decades, I have heard various reports of six- and seven figure annual deaths from properly prescribed, properly administered prescription and non-prescription drugs. Depending on how the numbers are viewed, anywhere from 150,000 to 850,000 people die a year just from properly prescribed, properly administered prescription drugs. And that’s on top of inappropriately prescribed drugs (Michael Jackson, anyone?), errors in filling the prescription, mistakes in taking too many or the wrong drugs, or intentionally taking the whole bottle. Yet I do not see any “drug safety” act being passed to ban prescription drugs.
And I do not believe that hogwash about people dying from not getting appropriate medical care. Anyone should have the right to take that risk–self-treating diseases like diabetes, heart disease, cancer, and the like. If you wish to treat it solely with vitamins and/or herbs, you should be allowed to take that risk. You are hurting no one else by doing this (except the drug companies that are trying to take the world at gunpoint and jail-point). However, one should not be forced to accept the risks of treating diseases solely with allopathic medicine against one’s will–Patrick Swayze should be able to attest to what happens when natural medicine is not even looked at as an option.
I suggest that, if anyone votes to support this vitamin ban, or anything like it (or anything that could set up a ban on vitamins), that the voters should support a ban on that politician’s election prospects. And, give new elected members of Congress fair warning that selling out to the drug companies will result in immediate impeachment and disgrace.

Everyone is against you in this forum, it would appear. I am not. If, after reading it thoroughly, you guys are convinced it is a wise move, then do it. A lot of what we poorly informed consumers waste our hard-earned money on is useless or even BAD for us. Most people do not even need vitamins, generally. I don’t think the German government is so out of line banning certain supplements. I am certainly glad to see a bi-partisan idea/effort… on anything nowadays!

I am shocked to find Republican supported legislation desiring to employ more governmental control on my rights as a consumer. But the American public understands this proposed bill as a thinly-disguised witch hunt. We understand ‘alternative’ therapies as simply the alternative to a synthetically orchestrated chemical manufactured by a company with large pockets and even larger influence.

The ethical supplement companies comply with and exceed FDA guidelines, providing a reliable health-promoting product.

The American public deserves to be informed about what others (leaders and govt decision makers) think is good for the masses. However, more regulations, fines, and a mountain of paperwork later in the name of safety with food suppliments is both unnecessary and expensive. iT IS QUITE POSSIBLE TO DIE FROM DRINKING TO MUCH WATER SO WHY NOT REGULATE AND PUT PEOPLE IN JAIL FOR WATER DRINKING TO EXCESS. It will surely only result in much higher prices and blockade of helpful suppliments so that we are protected (much as the Soviet Union used to protect their citizens from exposure to foreign thought through a similar blockade called the Iron CURTAIN. While the Soviets realized the stifling effect and have losened their control of free enterprise the US moves ever closer to socialism in the hands of an ignorant few, who make work where there is no real product, and over-regulate virtually anything and everything under the sun. Truth in labeling would be welcomed by most, perhaps 2 labels one representing common use of a nutrient and the other the usual FDA rhetoric about safety and danger. Then the consumer (who isnt as ignorant as uncle Sam would have us believe) could make their own informed decision. I have practiced medicine for almost a quarter of a century having worked on both coasts at major medical centers like New York Medical College and UC Irvine MC and am a professor at the local medical school and have received the American Medical Associations Physician Recognition Award for 4 years running. I have never seen but only heard by reading old texts; of any vitamin or suppliment toxicity and not even a minor adverse event. With nutrients with this kind of safety profile surely should be left to the consumers discretion. If we dont we will be starting a rediculously expensive machine to do what is a common sense task. Obviously, we will certainly succeed only in pushing prices through the roof everything cost alot more to support more desk jokeys. As far as Im concerned and I have poled about 39 physicians at our hospital; the FDA and like organizations function should be limited to informing the public not arresting them. More & more, regulations (mostly sponsored by pharma) are taking away individuals’ rights and opportunities to determine for themselves what is good for them. The food industry is a good example, as is the pharmaceutical industry, of the unwholesome and dangerous food and medicines that poople are “encouraged” to use in order to be healthy. We know what is good for us, and the difference between natural wholesome supplements and the stuff pharma is pushing.
It’s time that Congress works on a plan to get our country out of the economic mess it is in. It’s clear that big pharma has the tighest grip on Senator Cain’s balls. It is a choice of every American to purchase and consume any type of dietary supplement they choose. We are not asking Congress or big pharma to make this choice for us.

Canada here. You cannot tell me there is no collusion regarding this between the US and Canada . Later this year, Bill C-6, also known as the Canada Consumer Product Safety Act ( CCPSA ), will be reintroduced. This is, similarly to what McCain wants to sponsor, an attack on supplements. It gives Health Canada sweeping powers to enter private property without a warrant and search and seizure rights never before heard of.
This is very clearly an attempt by the pharmaceutical industry to clear the field, and monopolize health care.
Apparently, Health Canada is moving us towards a civil law model where rights are vested in the State, rather than the individual. This is occurring to harmonize regulations for international trade. If North America adopts the European Union model, the two trade areas can trade freely. This will benefit large corporations, and not the consumer.

what so unbelieveable is, that if you visit a dr’s office for and examine etc, if you question him about a herb or vitamin etc , he looks at you with a blank stare or you go some hearts dr’s and other dr’ s you will find them selling a product vit or herb and saying theirs is the best. As for scrips they are handed out like candy with little or none research. It would appear they want the power to have you come to their office ,thereby getting paid for the visit and possible a kick back from the pham companies as they get from scrips, evidence of this goes to the incidence of (RED YEAST RICE) IN PLACE OF LIPOTOL don’t know if i spelled that right — but look at the evidence a long the line, omega only by the drug companies and vitamin d , etc all replacing the major drugs and the bad effects they produce in almost 99% of the proscribing. Herbs & supplements have turned my health around. Many of these have centuries of anecdotal use. Limiting our access to these supplements because of the misuse by professionals who should have been monitored by the current laws that are already not being enforced is like closing the gate after the horse is out. It solves nothing and only makes the situation worse.
Please, do not limit our access to those natural supplements which are not currently controlled by the FDA. The Federal Government needs to concentrate on National Security, and a “hands off” policy in all areas best controlled by a free market economy.
It is my right to take my health into my hands. It is my responsibility to research what goes into my body and decide what I need – not the government’s.

I definitely do not agree that dietary supplements should be treated as a prescription drugs as that would not only inflate the cost. It would not give me the liberty to take herbs or food supplements. I do not understand why FDA wants to regulate this when good products speaks for itself in the avalanche of vitamin supplements in the market.
I strongly recommend that you STOP this bill in its tracks. Regulation of natural vitamins and supplements is the worst thing anyone could do. This looks like another attempt to give unwarranted economic power to greedy drug companies and impair the public’s ability to make their own (adult) decisions on health care. How many more issues will be attacked in this arena before this country has a viable health care plan that’s anything close to other countries? How much more nitpicking of our rights do we have to put up with before someone puts a halt to the idiocy? I’m a long time user of beneficial vitamin and herbal supplements, some of which have even recently been recommended by my mainstream primary care physician. Why? Because the prescription drugs caused side effects that I’m still suffering from and the medical condition still needs to be treated with something. Even my own doctor admits that an all natural supplement is worth a try. In the meantime, I’ve found natural vitamins to be an important health tool that keeps me in much better condition than if I depended on my doctor to prescribe pills that don’t work and cost much more than I can afford. Leave my supplements and only form of health alone! I have taken to managing my own health with diet & supplements and information – since mainstream health care became way too expensive for me some years ago (stuck working in temporary jobs for years with no health insurance).

Why should the American people not be allowed to make our own informed choice about something that seldom does harm and most often, does much good? If you really think the government should be the one to make choices about what’s healthy and what’s not, then why not pass a bill against something everyone knows is unhealthy: cigarettes? Why not close all of the cigarette manufactuers down rather than allowing people to make the choice whether to smoke or not?

The sad thing is that the precursor laws that allow this to happen were supported by the majority now in opposition, due to the fact that now EVERYONE’s freedom is threatened. When we lost our ability to practice entheogens, no one cared because it only applied only to a select group. When we lost clove and flavored cigarettes(cloves) and papers, and the FDA gained regulatory powers on tobacco, again no one made a stir on the behalf of the minority. Now that the threat has grown to include millions of people, pursuing unsanctioned healthy lifestyles, suddenly the public becomes aware. By now though, most are addicted to silver bullet vitamins and synthetic drugs to address every minor ache and twinge. I propose that every individuals body and personal space are sacred, and to breach that trust in ANY way, is to sacrifice to mantle of authority as a governing body.
And I would bet that no “green” poster is going to go pop some valerian root to forget this issue, less than can be said of the opposition.
People who take supplements do their own research to find out which brands are the most reliable and provide the best nutritional support. We do not want federal government control over our vitamins and supplements! Keep your nose out of it! We do not want to be required to have a prescription to purchase our supplements. The costs would skyrocket!
I recently had to be on a prescription antibiotic for bronchitis, and seven pills cost $126.00. That is $18.00 per pill! Ridiculous! The prescription drug industry should be the ones being legislated against to bring their costs down.
Please, Senators McCain and Dorgan, withdraw this DSSA bill. We the people do not want it!
I am a dentist and write a letter every year to my patients about how to have good health. If the McCain bill is passed most of the suggestions would go down the tubes because they depend on supplements. These letters can be downloaded from “annual letters” at http://www.pulleydmd.com.
An example is a group of supplements that stop a cold or flu if started as soon as soon as symptoms develop. Supplements are infrequently dangerous. Drugs need a prescription because they dangerous. We need more freedom, not less. This is especially true with respect to health. If this bill passes, sickness and health care costs will go up substantially.
Please do not cosponsor this bill or vote for it. Supplements when understood and correctly used are an important health protector and promoter. The right to access supplements must be protected for the American public. Our food supply is inadequate and nutrition supplements are important for us. — They are so important, in fact, to protect health and avoid excess medical interventions that I actually propose that in the health care legislation, nutritional supplements should actually be tax deductible just like prescription medicines are.

In order to control vitamins,and other food supplemnts, I would recommend you keep the drug companies out of it. Remember when red rice yeast was found to help lower cholesterol? MAjor drug manufacturers rallies to get the derivative that did this,taken out of the mix. So red rice yeast is no longer effective the was it was when first discovered. Remember all prescription drugs were originally derived from a plant.
. Passing this bill would obviously lead to a few large drug manufactururs to take over this industry. Why would they want us to take food supplements when they are in the market to treat DISEASE., and a far from wanting us to stay healthy!. Then the insurance companies would get involved because if we remain healthy the next generation will be even healthier and have no need for insurance! AND THEN the medical Drs would get involved because they would have no one to treat! NO COME ON! We are here on earth to live healthy prosperous lives.

Please don’t support the Dietary Supplement Safety Act of 2010. It takes away my options to choose my preferred medications/supplements and gives too much power to the FDA to address their own agenda which is usually hostile towards natural medicines and supplements that are both effective and sustainable.
Please do not allow this kind of legislation to interfere with my use of supplements. For a candidate who proposed that Americans need less government interference (Mc Cain), this surely seems contrary and hypocritical. I do not want to have to get a prescription for my vitamins!

I am happier and healthier than I’ve ever been in my life. I’m about to turn 60. I’ve done a ton of research on my own to find out the best suppliers of the best supplements at the best prices and the diet and lifestyle change needed to get to where I’m at. I’m a full-time artist and make a poverty class income. I can’t afford to be sick but I can afford the food and supplements that make me healthy.
I, as most people should, have taken my health into my own hands througn diet, lifestyle and supplements. These are the three legs my health stands on. Remove one and I don’t think I’ll be as healthy as I am.
My cholesterol is very good as well as all my other numbers (Blood Pressure, Blood sugar, others) and the supplements I take are a huge part of me being able to maintain them.
My doctor is amazed that I have reversed pre-diabetes and knocked 100 points off my cholesterol in 3 months. Pardon the details but a little while ago I could barely maintain a decent urinary flow. Because of the very inexpensive supplements I take, I pee like a fire hose. The only side effects of my therapy are positive, just ask the women in my life.
I take zero prescription drugs. I can ride a bicycle 50 miles here in hilly Eastern Pennsylvania and I’m able to lift 100 lbs over my head from the floor. How many 60 year olds do you know who can do that?
I”d hate to see some politician (most likely taking money from Big Pharma) screw me and all my fellow health conscious people out of all the time and energy we spend reading, studying and practicing our positive lifestyle.

I am not sure why certain political parties allow hundreds of chemicals to be rpoducced without studying their harm to the environment and go on about personal freedoms when it comes to automatic weapons, and yet my choice for a supplement is limited?

As the policy of the FDA regarding the supplement health is largely influenced by the Big Pharma, I vehemently am against the bill, the Dietary Supplement Safety Act being in process for the passage. It is ineffective and meaningless. It does not benefit anyone, but the greedy Big Pharma whose only interest primarily is the profit and our health secondary. Such bill implies the lack of the trust of the government, including Senator McCain in judgement of the ordinary people in our free will. It means more government power and control against our precious freedom. We don’t need any bill more than what we already have such as the Dietary Supplement Health and Education Act. The Big Pharma ought to be controlled, not us, the free loving people.
I am disappointed that Senator McCain who sometimes inclines toward socialism has sponsored such a bill. President Obama, a socialist that he is, would gladly sign it into law that certainly would add costs to the taxpayers beyond our limits and, thus, deprives our freedom. We are losing Freedom. Senator McCain does not help.

There should be more regulation on the pharmaceutical industry but I suppose it’s hard to bite the hand that feeds you…well.
Looks like anytime people start taking some money away from the doctors and opt to stay healthy and not get sick so they will not have to go to the doctor and pay him to get them well there seems to be a problem. I have used nutritional suppliments for over 20 years and I know they have had a positive impact in my over all health and well being.
PLEASE take a close look at what you’re doing. The FDA already has wide authority to approve of DANGEROUS products in our marketplace. Trace carcinogens in every day products that the FDA knows about and approves of? And now this? What needs to be regulated is the SOURCE of their ingredients. Ex: Centrum has been proven to extract its ingredients from carcinogen sources, esp. the iron. Johnson’s and Baby Magic have been proven to have carcinogens in their products, and the FDA went on record to say it’s “just a little bit.” “Just a little” every day in an average of 15 personal products applied daily is absolutely not safe. Let’s take a good look at what we’re doing here. Allow people to have liberty to make their own choices for safe and ethical products.

Please do not mess with the few choices I still make for myself. I am of average intelligence and am capable of researching and deciding for myself. I have Stage 4 colon cancer and am doing better than expected. My supplements have kept me strong and I have tolerated Chemo better than the average patient.

When is the government going to let us act and choose as adults? I am sick and tired of them treating us as if we haven’t got a brain in our heads. STOP the regulations and laws already. We are not children and we DO NOT need to be guided by some misguided “lawmakers” to tell us what makes us feel better. If you want to or not want to take a particular vitamin or herb to help yourself that is your decision. This is suppossed to be a free country an we are getting less and less free by the minute because the lawmakers have to seem all self important.
