Pre-Market Approval of Dietary Supplements: The Canadian Story

In the 1990s there was a citizens’ rebellion in the US wanting to protect their access to dietary supplements. This led to the passage of the Dietary Supplements Health and Education Act 1994 (DSHEA). Under this Act, supplements are classed as a food and are presumed to be safe unless there is evidence to the contrary, and the FDA is not supposed to remove a supplement unless there is evidence of harm.
Soon thereafter, a citizens’ rebellion also occurred in Canada. Canadians made it clear that they were fed up with supplements being taken away, and they demanded increased access. One would have supposed that, having watched the US preserve its access to supplements, that Canada would follow suit. Instead, in 2004, Canada decided to treat supplements as a type of drug. All new supplements in Canada are presumed, to be both unsafe and ineffective (and therefore illegal); only those that can go through a pre-market approval process can remain on the market. To get approval, a supplement must be shown to be both safe and effective. This sounds reasonable on paper, but it has led to unfortunate health consequences.
If safety were a top priority, then a balanced risk assessment should be undertaken: the risk of taking a product away from people who are relying upon it to manage their health conditions, balanced with the risk of leaving the product on the market. It is dangerous and intellectually dishonest to remove a product due to a perceived “risk” without also taking into account the risk of removing the product.
Let us use nattokinase as an example. Nattokinase, an enzyme extracted from a fermented soybean product called natto, can be used as a natural blood thinner. In Canada, a decision was made that no approvals would be given for nattokinase (meaning it had to be removed from the shelves)—but the decision’s timing was telling. The New York Times, in an article called “A Promising Drug with a Flaw,” reported on a problem with Pradaxa, a blood thinning drug. Apparently people showed up at the hospital because their blood had become too thin, only to find there was no antidote for Pradaxa the way there is for other blood thinners such as warfarin (which is also used as rat poison).
However, a search of Health Canada’s adverse reaction reporting database does not reveal a single death caused by nattokinase. By banning nattokinase, Canadians whose conditions were being safely managed with nattokinase had to transition to pharmaceutical drugs that carry much more risk. You cannot move people from a low-risk product to high-risk products without health consequences. The banning of nattokinase will almost certainly cause deaths in Canada, a health consequence of “pre-approval.”
The Canadian experience shows that pre-approval also shuts down innovation. Before pre-approval became law in Canada, innovative products would disappear if they were not effective and would thrive if they were effective. Several key products that have had tremendously positive health benefits were introduced in Canada prior to the pre-approval regime. With pre-approval, the efficacy of a product must be proven to the government before it can be sold. For a new product, this means clinical trials, the cost of which has dramatically reduced innovation in Canada.
There has also been a “dumbing down” of products in Canada. Health Canada has required the amounts of therapeutic ingredients in many supplements to be reduced as a condition for approval. One manufacturer shared with me at a public forum that they decided to stop selling a key product because they knew it would not be effective at the “approved” amounts and they did not want to defraud the public. There are, of course, health consequences to rendering effective products less effective.
So what will happen if the US adopts the same paradigm as Canada? Several anti-supplement legislators have already proposed a pre-market FDA approval system for dietary supplements. Requiring supplements to be proven safe and effective to the FDA’s satisfaction before a license is granted—that is, with clinical trials costing millions or billions of dollars for each supplement—is insupportably expensive, with manufacturers unable to recoup their investment because the products are not usually patentable. This will only restrict access. And if the FDA wants to restrict access to supplements and promote access to drugs (which is demonstrably the case, considering the fact that the pharmaceutical industry funds 60% of the FDA’s drug review costs), then giving the FDA a mandate to reduce access should set off huge alarm bells. Moreover, because so many Americans rely on them to manage serious health conditions, the health consequences of such a regulatory change need to be taken into account.
The concept of pre-approval also carries an interesting philosophical change. If it is accepted that only products approved of by the government can be sold, then Americans are no longer free to decide how to manage their own health. In effect, pre-approval gives the FDA a veto over personal health decisions. Anyone supporting a pre-approval plan must understand that it will undermine the right Americans currently have to make personal health decisions.
I should disclose that I have a personal interest in the US keeping its current system. Because I live in Canada, there is a list of products I can no longer purchase in Canada due to our pre-market approval scheme. I purchase those products in the US. Indeed, when I bring this up in lectures, almost everyone indicates they do the same thing. Perhaps the most telling indictment of pre-market approval is the fact that a large number of Canadians now rely on the US marketplace to get supplements they need to stay healthy.

I am in the same boat – I spend $150+/- a month for my wife and myself on supplements that I buy from Vitacost or Swansons in the USA, I rarely now visit our health food stores except for common things like vit D3 or co- enzyme Q10. Although I am Canadian this is the first sensible explanation I have received for the cross border discrepancy.

  5. I would be ever so thankful if the government kept out of my health care choices. I take supplements – and I chose them wisely, based on the manufacturing facility being under FDA inspection. I am 79 years old, and have been taking supplements for many years – and am on no prescription drugs. If I ever need an antibiotic, I have taken them for five days or so. I control my blood pressure with organic apple cider vinegar – I take fruits – vegetables – berries in supplement form made by Juice Plus. I did notice that over- dosing of prescription drugs causes many deaths worldwide.
    I think it is morally wrong for drug companies to interfere with this industry and I find it offensive that they are bankrolling this action.

  11. Considering that 99% of all soy is GMO I want nothing to do with anything from that plant. There is a logical reason why we have these laws. I want nothing to do with lethicin either – soy.
    I believe in vitamin/mineral supplements; wholesome non factory farm foods and herbs/spices natural curative properties. Natural remedies can make a big difference and no I don’t even use aspirin let alone that poison crap the drug companies put out.
    I reject any claims that purport to cure cancer or any other miracle claim. The aforementioned can help your immune system and your body to remain healthy. So can a modicum of sensible exercise; sleep and a positive attitude whenever possible.

I also work with my osteopathic physician and use supplements that are recommended through consultation I would not want these to become controlled by the pharmaceutical industry, overcharged and prescription required.

They have tried to take vitamain C off the market I think. This is terrible for Canadians and I didn’t realize that it was this way there. I am against any restriction of our right to buying supplements and am very anti-pharma. I restrict any prescription drugs to the very minimum (I am a Type I diabetic, so take insulin). Prescription drugs kill tens of thousands of people annually, but vitamin supplements kill no one. I’m disgusted with the control the Pharmaceutical companies have with Govt., and the F.D.A. is a fraud in doing it’s job i.e. protecting the public regarding food and drugs. It is, instead, a whore for Big Pharma.

It is about time that the FDA would accept that regular medicine is not the A and O today. Natural medicine is in my mind very superior to chemicals, which all have tremendous side effects, and as long as they are mentioned the FDA accept it; but if natural pills produce a hiccup, they are taken off the market.

Since they do no harm, they should be left alone.The Government has no right to involve itself in our personal health decisions.     Making supplements part of Big Pharma will put them out of my reach unless I let my Government buy them for me.

  43. I think this is outrageous..first we are being poisoned by GMO’s (which the majority of Americans are against & want them labeled to make an informed choice not to eat them). Now because people are choosing to take supplements rather than drugs & they are helping..”big pharma” is annoyed & has bamboozled the FDA & legislators to buy the nonsense that supplements are unsafe. There are clearly documented cases of supplements working to help thin blood, help bone density, etc. I am one of those people whom the MD couldn’t argue with my “dramatic” results of taking Vitamin K2 with Natto to help improve my bone density! As an American, I should be able to make my own choices when it comes to my health by using supplements of my choice as well as the food I eat!!
    The FDA was formed to protect the American public & in my opinion, of late you are failing terribly!

And the list of side effects are often worse that what a person is trying to manage or cure. Supplements do not harm.

It’s extremely alarming to think the government wants to control all aspects of our personal lives,including our health. SOme supplements like red yeast rice is proven to lower cholesterol without all the side effects of drugs for the same purpose.       “THEY” do live not under the same conditions, restrictions and laws that they place upon us; they are certainly not limited to the same foods, medications and treatments options.

  65. This regulation is in full force in South Africa at this time, apparently with the view to implement it throughout Africa in record time. It appears that all natural products have been declared ‘medicines’ and the merchants of those must prove it to the contrary. This is the way I understand it.

I am not educated in the way the Canadian government works, but can’t they propose legislation similar to the USA’s DSHEA to protect their supplements? Are the Canadian people too complacent? We here in the USA fight tooth and nail every year to protect out supplement rights, the Canadian people need to get good and fed up with the government controlling something that should be as God-given as food. The power is in numbers, that has never changed. Stand up for these rights or lose them.

    Its getting to the point where people need to stop complaining about the crony agencies on public forums and actually do something about it. Talk is a cheap way to vent frustration at feeling powerless, but it does not bring any lasting change.

  77. We really need to ask if these pharmaceutical drugs that are killing us, are really intended to kill us.
    Some of these meds have such effective and safe alternatives that it makes no sense at all that they are legal and available. What are they trying to do, Kill us? Yep.

And as a Canadian to see our Freedoms disappear, like the Freedom of Choice in Health Care (not the sickness care system we are presently living in) is a very sad day. It seems to me that why more Canadians and from what you indicate in this article our American neighbors are not up in arms over this issue? Answer: We are not FREE!
