Will Integrative Medicine Be Driven Out of Washington State?

The evidence seems clear that the Washington State Medical Board is trying to do just that!

Doctor says "NO"This has been going on for nearly two decades, but has intensified lately. Government licenses are not meant to be used to enforce monopolies. Restraint of trade is against the law. It is time to call the Washington state board to account for its illegal targeting.

In May we told you about Washington state’s ongoing attacks on natural health pioneer and integrative physician Jonathan Wright, MD. You may recall that Dr. Wright’s Tahoma Clinic had hired a medical doctor who’d been licensed in another state, under the condition that he apply for a Washington medical license. He did so, and the doctor’s Washington license was listed as “pending” on the state’s Medical Quality Assurance Commission (MQAC) website. During this period, Dr. Wright followed the legal advice he had received and monitored him closely as required by Washington law. Suddenly, MQAC charged Dr. Wright with “aiding and abetting the unlicensed practice of medicine” because the doctor’s out-of-state license had been revoked!

At the initial hearing, at least four MQAC staff members admitted that they knew from the beginning that the doctor’s out-of-state license had been revoked and that he could therefore not be licensed in Washington, but they never put that information on the MQAC website (which continued to describe the physician’s Washington license as “pending”) or told Dr. Wright about it. Yet MQAC charged Dr. Wright with “aiding and abetting the unlicensed practice of medicine.” This seems to be the very definition of malicious prosecution.

When MQAQ handed down its decision, Dr. Wright was found guilty of an infraction he hadn’t even been charged with at the hearing: failure to follow a statute governing the practice of an out-of-state doctor whose license is pending. The statute says the out-of-state doctor must not solicit or take on patients in his own name, and must not open his own office—provisions Dr. Wright followed to the letter. So he was sanctioned for a charge they didn’t make in the first place, and of which he is demonstrably innocent.

In its decision, MQAC suspended Dr. Wright’s license for ninety days (ending mid-September), after which he will be on probation for thirty months. Taking away a license on a charge that wasn’t even addressed in the hearing would seem to us to be a clear violation of the Fourth Amendment of the Constitution, not to mention an act of defamation.

In addition, Dr. Wright must pay a steep fine; appear before MQAC annually to report on any new NDs or MDs his clinic has hired; and submit a paper to the Commission describing the importance of proper licensure.

This last requirement may seem like nothing more than an insulting joke, because it was MQAC itself that concealed the fact that the applicant’s license had been revoked in another state! In fact, it’s much more than that. Forcing him to write an essay and tell MQAC what they want to hear is, it seems to us, a violation of Dr. Wright’s constitutionally protected freedom of speech.

Dr. Wright’s appeal is expected to be heard in December, but the judge hearing the case denied him a stay of the license suspension, so that he currently cannot practice.

This is not even the first time that Dr. Wright has been targeted by MQAC. He has been repeatedly harassed. The last episode before this one involved MQAC charging that his phone system was not responsive to patients, a charge that was a complete fabrication and which was eventually dropped after considerable legal expense.

We wish we could say that Dr. Wright’s treatment at the hands of MQAC was unique. Unfortunately, Washington has a clear pattern of bias against and malicious treatment of integrative physicians—even without a patient complaint of harm or other allegation of harm. As in most states, there are relatively few integrative MDs or DOs in Washington, despite that state’s reputation for openness to alternative ideas. A majority of them have been targeted by MQAC. Here is a brief summary of some of the cases:

  • MD 1: Investigated by MQAC for making a diagnosis of mercury toxicity in a teenager whose symptoms matched those listed for mercury toxicity in a standard toxicology textbook. Lab tests confirmed the diagnosis. (The teenager had been eating large quantities of canned tuna.) The case closed by MQAC after the doctor spent a large sum in legal defense fees.
  • MD 2: MD 1 referred the above mercury toxicity patient to MD 2 for treatment. The patient and her parents insisted that no harm had been done, and that her health had significantly improved after MD 2’s treatment, yet MD 1 was found to be at fault for not referring the patient to enough specialists (even though she had previously seen three, including two neurologists, prior to seeing MD 2, and MD 2 had referred her to three more, for a total of six)! MD 2 was also found to be at fault for agreeing with MD 1’s diagnosis of mercury toxicity. The “expert” upon whom MQAC relied during the disciplinary proceedings had not practiced medicine in seven years, and admitted when questioned that he had miscalculated by a hundredfold the dose of the treatment material in an IV given by MD 2.
  • MD 3: In the only case stemming from a patient report, a patient allegedly complained about a holistic medicine procedure (known to be harmless) which MD 3 discussed but did not use with the patient. MD 3 was also charged with diagnosing lead toxicity based on blood, urine, and hair specimens. MQAC charges included violations of interstate and intrastate commerce, unprofessional conduct and, believe it or not, “moral turpitude”! Even though MQAC found that no harm was done, and even though the complaining patient testified that he was not harmed, MQAC suspended MD 3’s medical license for five years, staying the suspension on condition that he use only MQAC-approved techniques from now on, that every three months he submit a signed affidavit that he isn’t using the technique he personally judged best, and that he meet with MQAC and be interrogated every six months in a town over three hours away. His legal costs so far have been over $250,000.
  • MD 4: MQAC’s investigation concerned his use of intravenously administered vitamins and minerals. MQAC demanded to know if he had diagnosed vitamin and mineral deficiency before giving such IVs—even though less than a year earlier, NIH researchers found that high-dose IV vitamin C might kill cancer cells but did so without diagnosing scurvy (vitamin C deficiency)! In fact, of the sixteen physicians who use use IV nutritional therapy in Washington, eleven have been charged by MQAC.
  • MD 5: Investigated by MQAC for “off-label” prescriptions of human growth hormone (HGH)—a natural substance and an FDA-approved medication—to four patients. “Off-label” prescribing of medications is 100% legal, FDA-recognized, and done by every licensed physician in the US. Even though it was prescribed for a specific medical condition, all patients reported improved health, there was informed consent, and none of the patients reported any harm, MQAC suspended his license for three years and fined him $5,000.
  • MD 6: Another integrative doctor targeted for prescribing HGH; MQAC decided that there was not enough medical justification (as defined by MQAC) that the patient required HGH. He was placed on probation for five years, has to undergo a two-day ethics course and submit semi-annual practice reviews, and was fined $10,000.


In evaluating the treatment of MDs 5 and 6, consider the board’s treatment of another doctor, whom we will call MD X, not an integrative doctor but rather one practicing conventionally. MD X also prescribed HGH off-label, as did MD 5. However, he prescribed it for a family member (his stepson) without any recordkeeping—and did so not to treat an illness but rather to help his stepson grow taller, even though his stepson was 5’9” tall and weighed 152 pounds, normal for a young person his age. Under Washington law, HGH can only be used for the treatment of a disease or medical condition. MD X’s penalty? Nothing more than a reprimand and a $5,000 fine. In fact, five of the six charges against him were dropped because there were “mitigating circumstances:” no actual harm to the patient! This is not a leniency MQAC gives integrative physicians, or each of the doctors mentioned above would have had their charges dropped, too!

MQAC charged two other conventional doctors for prescribing HGH, and they too got off much lighter than their integrative counterparts. One was placed on two years’ probation and fined $3,000; the other was placed on four years’ probation and fined $8,000. Neither one had their license suspended or was required to submit a performance review.

There is a lot more to be told here: other unfair and malicious charges against integrative doctors, as well as leniency toward or no charges against conventional doctors with actual patient complaints of harm. Take, for example, the case of one Washington patient whose conventional physician mis-prescribed a drug contraindicated for the patient’s condition. The patient died, but MQAC refused to investigate, much less charge the doctor.

There have also been numerous complaints of sexual misconduct. In 2006 the Seattle Times found that in the previous decade, state regulators dismissed almost a third of all sexual-misconduct complaints without any investigation. Even when charges were investigated and found valid, there were no consistent guidelines for discipline, and sexual misconduct was treated as a medical error or routinely dismissed and forgiven.

In short, there is a clear pattern of bias by MQAC against integrative doctors in Washington State. This seems to us to be a clear case of the discriminatory application of Washington’s laws in order to drive integrative physicians out and protect conventional medicine’s treatment monopoly.

This is not just a recent trend. We have found other cases going as far back as 1994 in which MQAC unfairly and unreasonably targeted CAM practitioners and integrative doctors. One physician, who had been trained in biofeedback and acupuncture, had purchased an FDA-registered medical biofeedback device based on electroacupuncture, and used it for food allergy testing. When he learned that FDA had not approved the device for allergy testing (contrary to the manufacturer’s claims) he got rid of the device. Yet MQAC still found him at fault for relying on the claims of the manufacturer and saddled him with endless legal bills ending in a trumped-up “settlement.”

This situation is all too typical. The state has limitless legal resources. Physicians usually are not rich. So just the threat of legal action is often enough to create a climate of intimidation in the medical community. Also consider that a physician has invested so many years and so much money in his medical degree or license, but may lose it just by getting on the wrong side of the all-powerful medical board.

Many integrative doctors, faced with outrageous legal bills and fines because of MQAC’s baseless attacks, agree to make everything go away by signing consent decrees with often draconian and humiliating provisions. Some legal experts feel these consent decrees violate the restraint of trade doctrine, which relates to the enforceability of contractual restrictions on the freedom to conduct business.

One bright spot in all this: the Federal Trade Commission is now scrutinizing some state laws and practices that create anti-competitive behavior by physicians—such as the scope-of-practice restrictions supported by physicians who trying to monopolize their field. In Tennessee, for example, only physicians were able to provide interventional pain management services. The state legislature wrote a bill that eliminated that requirement—and FTC weighed in on the bill, to the consternation of conventional doctors in the state. Happily, the bill passed.

Perhaps MQAC should rethink its discriminatory attacks on integrative physicians in Washington State before the FTC investigates MQAC for anti-competitive behavior. Or before a lawsuit is filed to bring this restraint of trade and malicious prosecution out in the open.

As someone who has experienced conventional medical practices as well as alternative methods, I find it very disturbing that mainstream practitioners are grilling those who actually have found and used non-invasive ways to heal. I’m sorry, but greed (as in sale of pharmaceuticals and hospital regulations) is not a reason to keep propagating ways that actually harm and kill. I pray that those in conventional medicine open their minds and realities to processes that actually promote healing in people. When that happens, it will be good for all — yes, even for those who want to stop the processes that are taking patients away from them.

  4. Absolutely astounding!!! I work in the field of western med, after seeing what I have seen I treat with anything but western med!!! I am seeing more and more “lack of teaching”, “lack of true compassion” and skipping out on conservative treatment especially nutrition. Get your back up folks, this type of care is here to stay. MD’s that have to meet a “surgical quota”??? What do you tell people that are so gullible? After the fact? After the surgery makes the condition worse in 2 years? Yeah, how about “discograms”???Fusions???It is not pretty anymore. I am getting out and going “alternative”. I am 52 and do not take any medications and am very healthy. I attribute this to “knowledge” and avoid all GMO products, treat myself with nutrition. It is an absolute mess out there and Dr. Wright is one of the ones who cares…what a shame and a SHAM!!! Where are the petitions I can sign? Where are the people that should speak up? What is America becoming? Distant shores look so good anymore!!!

  5. I wish I was as optimistic as you are regarding the outcome of the MQAC and Dr. Wright. Integrative Medicine has been under “fire” for a long time.
    When I filed a complaint against a person impersonating a physician in Eastern Washington…despite the fact I had a ton of primary evidence they said quote, “they could not charge or find guilt with a person impersonating a physician because that ordinary person is not under their jurisdiction.” This was in about 2006 or 2007.

    Based on the info you supplied here today. I am amazed that the Washington Medical Board has done so many antagonistic steps toward integrative medicine practitioners, and gotten “away wuith it”….that I see there is no stopping them.
    They have found a way to persecute those who have been successfully treating thousands of grateful patients,…… to try to prevent the alternative and integrated physicians to not only treat patients, but to actually drive them out of the state, thus to PRESERVE THE CURRENT STATUS OF COMPETITION.
    Previously I had hopes that the rights of Dr Wright and others like him would finally be protected.
    But based on the info presented, and the track record of Washington State’s past behavior….it is clear to me that the state will probably win against the good doctors, …….by being getting away with their CRIMINAL actions against Dr. Wright……….
    It seems that the Mafiosa-like behavior of the States henchmen …….will win over the righteous conduct of Dr Wright and his like minded colleagues. MUCH to the loss of the many patients who whill no longer have access to a better kind of medicine….I cry for the evil behavior winning over the righteous behavior…
    but the records you provide …..demonstrate that even the judicial system there seems to be insufficient to prevail in true justice …..in favor of warped and evil decisions that allow the state to continue ruthless and unrighteous persecution….. to drive out the finest medical treatment sources.
    Looks like the bad guys are winning, due to the twisted decisions of the criminal medical board, supported by the criminal decisions of the state.

A former Integrative M.D. who diagnosed and served me exceedingly well and professionally in North Carolina, was harassed for over five years by the state Medical Board to the point where he sold his practice and retired with his family. I not only held him in high esteem, but also the Integrative M.D. who took over his practice and helped me maintain excellent health without drugs, so that I am an alert, healthy female in my 88th year of life. I thank God every day for Integrative Medicine, which prevents illnesses and has no side effects.

  11. In Washington as in all of the USA, .MD’s are governed under military law, as in, MQUAC is a court martial. That’s why the surgion general is a 4 star general. Makes sense in a national emergency, the government doesn’t ask they will send a car. This allows the corporate oligarchy to maximise their blackmail methods of control over all health matters, including poisoning our food and water, (gmo’s, herbicides, fracking), etc., to make us sick so they can claim to make us well with their latest most expensive snake oil. When dealing with psychopaths, you have to think like them,just don’t make a habit of it. They call all of this, “economic activity”, and good for the GNP.

      The history is repetitious, so the main effects of the Holy medieval inquisition to end free thought and scientific thought are, alas, progressing.
      It’s a big shame that humankind (not the wild unconscious beasts) are doing to Dr. J. Wright and other gifted alternative-medicine doctors, whose achievements are outstanding compare to the humble ones of the orthodox mediocrity.

  13. I primarily use alternative care whenever possible.
    As a former LMP who received payments from insurance for medically necessary massage treatments, it would be criminal for patients to not be able to access a drug free, surgery free solution to physical pain.
    Closing doors to alternative care, will once again give all medical power to drug companies and major medical companies to regulate what patients are allowed in the form of treatments.

  15. I find the corruption of the FTC and the FDA, with the help of corrupt elected officials to be at an all time high. For those of us that have chosen to opt out of the medical/pharmaceutical driven “care” of today, it’s no surprise that they are trying to squelch therapies that work and don’t harm/kill the patient. It’s a greed driven system that no longers seeks a cure for any disease that may negatively affect profits generated by a sick society dependent on handfuls of pharmaceuticals that harm more than help. It’s a difficult time for any doctor who finds the methods of today to be innefective, and seeks to heal with more natural methods that actually work without the horrific side effects that society has learned to accept from pharmaceuticals today. I wish them well, and to persevere, there are many who are counting on them.

  16. It would be very interesting to see just who is ion the MOAC board ini Washington State. You can bet there is no representation of a Doctor who practices Integrative medicine. I know many people who have left conventional medicine and found health and healing with an integrative practicing Doctor. Hope this wakes up the citizens of the State of Washington to the BULLING practices of the MOAC…they should be replaced by a board that has ethics!

  18. Some medical people who have deliberately blinded themselves to the differences between honesty and dishonesty by pasting dollar bills before their eyes. Civilization destroying materialism.
    Such materialism has been the cause, in past history, of the destruction of entire civilizations. How much longer will our wonderful stars and stripes continue to fly with the continuous efforts to bring our flag down by profit motivated blind people.
    If medical people had a real desire to help people have real health then they would be exploring all health producing avenues, approved by the establishment or not.

  19. I was in a research program at the National Institutes of Health for a rare nerve disease for four and a half years. Using energy healing, I shrank a brain tumor and my hearing is improving. The response of the researcher was to have an NIH psychiatrist label me so severely mentally ill that I had to be thrown out of the study.
    The research doctor did a clinical trial study using one of the most expensive medications on the market. I got the same results using the power of my mind.
    I had a psychologist who understands energy healing [Qigong] write a report that totally debunked the NIH evaluation. I’ve written a detailed protest to the Director of NIH and a lady in Public Liaison and Communications, as well as the researcher. I didn’t get a reply. NIH’s motto is: “NIH…Turning Discovery Into Health”.
    Unfortunately, I am becoming more and more concerned about profit being the main motivator in our Western medical establishment. What happened to caring about people?

  20. It is obvious that integrated, holistic medicine represents the health wave of the future. Just as in all industry, the new-fangled stuff is systematically strangled by the existing moneymakers reluctant to see their control slip . . . but in the end, we will look back with amusement at these pathetic attempts to keep health treatment in the hands of physicians and supporting bad actors more nearly concerned with making their boat payments and closing on that third vacation home than doing their jobs and honestly helping their fellow man.

  21. Very much pleased to reply in protest against the “whited sepulchres” of allopathic medicine. Aren’t these guys aware of the public outrage over their enormously lethal medical system, and their disgraceful (in fact mind boggling!) overcharging in hospitals and clinics all over this country? ( see “Bitter Pill” in Time Magazine recently). Why don’t they clean up their own shameful problems, before they launch attacks against the far more benign, much less harmful medical practices of alternative medicine? Don’t they realize that Americans are justifiably afraid to go to hospitals today, because of the terrible rate of infections, the awful rate of incorrect administration of medications, and the huge, unjustifiable costs? They couldn’t look worse to the lay public, when they try to ruin the alternative medicine practitioners. What a bunch of hypocrites! Let Dr. Wright et al alone. They do much less harm than do their present attackers.

  22. My wife and I have been going to Dr. Wright for over 10 years, traveling from the East Coast. I am truly astonished at these attacks on Dr. Wright. Our experience with his clinic has been outstanding. Several medical problems of ours that had stymied the best Washington, DC, doctors were solved on our first visit.
    I would think that the media in Washington State would investigate this unusual situation where one of the best doctors in the world is under a kind of bureaucratic attack. I wonder if Big Pharma could be behind this because Dr. Wright’s understanding and treatment protocol exist in a parallel world and might be considered competition.

    1. Here in Washington State corporate and institutional conglomerates are very much interested in maintaining the status quo. I have learned this both as a professional and as a consumer in the over 6 years that I have lived here. I have been witness to MANY unethical and highly questionable practices on a number of fronts. As a strong advocate, I have known who to complain to, and, quite frankly, how to get things done. In many ways, I had more rights and was better taken care of in Wyoming. I knew the conservative ways there and could maneuver around them. Here, on paper, and to your face, professionals, agencies and businesses act ethical. Behind your back, those with power maneuver until they can blind side you with the kind of tactics taken with Dr. Wright. It is a corrupt and impenetrable system here. Change needs to happen from the bottom up!!! People need to become aware of the shady dealings afoot before making the move to this state!!!

  23. Please be advised that attacks on MD’s who step out of the box and learn how to heal people is the norm. This is happening all over the country. The most dangerous thing an MD can do is speak out against bioweapon vaccines, as I learned when I described how vaccines corrupt the immune system and cause virtually all diseases in internal medicine (in people and in pets); worse yet, I developed a protocol using homeopathy and natural therapies to reverse all these conditions. The NYS medical board went after me claiming I have a “delusion of conspiracy” because of a public access TV show I did revealing how sex abuse of children is being covered up by authorities; it was revealed later that the NYS medical board was, at the same time they went after me, covering up for a pedophile neurologist who had sexually abused over 100 autistic children (necessitating legislation be passed after outrage by the public that they turn over criminal doctors to the authorities).
    If people want doctors with a conscience to step out of the big pharma box, they need to stand with the doctors who risk everything to do the right thing. Under Obamacare, insurance companies will strong arm people to get vaccines, mammograms which cause breast cancer, etc., to keep their insurance. Until people learn how to just say NO, it is only going to get worse…

  24. I met Dr. Wright at a Medical Trade show when he came by my booth inquiring about our Electrical Stimulation technology and its various FDA cleared applications. I have been in the healthcare field for more than 36 years. My son is a D.O. and my daughter a PA. Dr. Wright was simultaneously brilliant and humble in the questions he asked and in the way he truly listened. What a rare genius to find in the Medical profession. I have trained over two thousand Doctors clinics hospitals and other healthcare practitioners in my career and Dr. Wright is one of the most kind and brilliant I have had the opportunity to meet. Sadly the Medical industry is still deeply entrenched in turf protection with big Pharma and hospitals attacking any non-drug non-surgical solution that could reduce the need for some of the $50 billion a year in pain meds or Trillion$ of other drugs or unnecessary surgery. The surgery suites generate the big bucks and the Universities protect the profits from that source and their grant providers from Pharma. The ruined lives get treated forever by the PT industry, their pain “Managed” by drugs until the systemic toxicity creates cancer generating all new profits for the industry which profits from disease and not health.   25. Like many others here I am appalled at the arrogance of the conventional medical “professionals” who get to bully anyone who does not agree to their principles of practice. How does this help me as a patient? Not at all. Patients are the ones who have to make the choice of their treatment. No one should be able to take that choice away.

GMO, – Monsanto is so ashamed of that, that they want to hide telling the truth about GMO foods on the label) pork & beef, chicken – Did you know that Russia has banned importation of beef & pork from America because it contains 20 % of a chemical that affects muscle growth in the animals. This chemical causes cardio-vascular problems in humans. High fructose corn syrup cause cancer, heart trouble, diabetes. Aspartame is even more poisonous. The word “natural” on foodstuffs has no regulation – you can call highly processed MacDonald’s junk food “natural.”

Latest data from the Virginia Board of Medicine Newsletter #72, 2013; 818 drug overdose/poison deaths in VA in 2011. 505 of these (62%) were from prescription (Rx) drugs. 113 (14%) were from street drugs. 143 (17.5%) were from a mixture of Rx & street drugs. Any way you do the math, it is an astonishing indictment of our drug-laden system. As a Chiropractor I am vehemently anti-drug, but the question must be asked – if we are fighting a “war on drugs,” who is the real enemy, the illegal cartels or the legal cartels? In modern day Virginia, the legal cartels kill 5 times the number of citizens than do the illegal cartels. Americans ingest more than 60% of the WORLD’S Rx drugs. Maybe we are too drug addled to wake up – I hope not. I have kids (unvaccinated) and I hope to have grandkids some day.

  27. Big Pharma, aided and abetted by medical schools, is increasing the drug-caused sicknesses and deaths in America.
    Politicians and judges are being seduced to help the destruction of constitutional freedoms.
    Why?
    The strength of ANY society at and time of history was is and continues to be the extent of obedience to Divine Law, not in tools for war.
    Profit motivation is a violation of the First Commandment and caused falling of civilizations throughout all recorded history. Egyptian, Roman, European Dark ages etc. – Our recent history is quite explicit that America is being destroyed. By whom? Very obvious.
