Two New Critical Senate Bill Amendments—Action Alerts!

imagesOne of these amendments we have seen before. It must be stopped. The other one we wholeheartedly support.

Every five years, Congress reauthorizes the Farm Bill. It sets agriculture (and nutrition) policy for the nation. It is always a “must pass” piece of legislation—and because of that, legislators tend to offer tag-along amendments that may have nothing to do with agriculture in the expectation that they will be passed along with the bill.
Of the over eighty amendments being offered to this year’s Farm Bill, there are two of particular interest to supporters of natural health. One is very, very bad, while the other is very, very good.
The first amendment, offered by Sen. Patrick Leahy, is a revival of Leahy’s disastrous anti-supplement bill that passed in the Senate last year but which we have so far stopped in the House. The language of this amendment is exactly the same as that original bill. Attaching the same text to a “must-pass” bill may the only way his language can become law—unless you take action to stop it.
The amendment would increase criminal penalties for “misbranding” or “adulterating” foods to a maximum of one year in jail to ten years’ imprisonment.
To our ears, “adulterated” means that the food itself is somehow tainted or injurious to health, or contains an ingredient that presents a significant or unreasonable risk of illness. And “misbranded” suggests deliberate misstatements about the efficacy of a product.
In FDA-speak, however, these words take on completely different meaning. For example, a food or supplement may be “adulterated” if it does not follow “current good manufacturing practices” (CGMPs), which are extremely wide ranging—and include minor recordkeeping violations. “Misbranded” can mean that the producer makes a completely true statement about the product but without FDA permission. A cherry producer who cites peer-reviewed scientific research from prestigious universities on the health benefits of cherries would, in FDA-speak, have engaged in “false” and actionable “misbranding” which suddenly turns the cherries into drugs.
The dramatic increase in jail time and fines will make supplement production an even riskier proposition than it is today. To his credit, Leahy listened to our objections and added some additional language. The ten-year jail term would apply to those who “knowingly and intentionally defraud or mislead” and do so “with conscious or reckless disregard of a risk of death or serious bodily injury.” But this language is subjective and vague. Whether anyone meets these criteria would be determined solely by FDA. People shouldn’t be put in jail for a decade  because of how a biased party rates their intentions; it should be because of their actions.
You also have to understand how the FDA operates. Its most favored tactic is to send in armed agents who terrify everyone. Then the intimidation escalates. The agents say that the producer, whether a supplement producer or raw milk producer, could spend years in jail. To avoid this, just sign a “consent decree” which among other things will probably require hiring former employees of the FDA at extremely high rates to monitor everything. Huge reports will have to be filed and if anything falls short, then the jail terms can be triggered.
Would the FDA assert that a seller of raw milk is knowingly and intentionally disregarding risk of death? Of course they would. So the ten-year jail threat would apply.

Speaking of raw milk, the second amendment, offered by Sen. Rand Paul, would allow for the interstate transport and sale of unpasteurized milk. While some states have passed legislation allowing raw milk to be sold within that state, it is against federal law to sell raw milk across state lines. This has permitted the FDA to pursue its current vendetta against raw milk producers and go after farmers like Daniel Allgyer for allegedly selling milk across borders.
Sen. Paul’s amendment would change that situation. It reads, in part, “A Federal department, agency, or court may not take any action (such as administrative, civil, criminal, or other actions) that would prohibit, interfere with, regulate, or otherwise restrict the interstate traffic of milk, or a milk product, that is unpasteurized and packaged for direct human consumption.”
As we have reported previously, raw (unpasteurized) milk is safe, extremely nutritious, and has been shown to be superior to pasteurized milk for protecting against disease.

    I LOVE your work. Amazing and so critical during this times of huge corporations.
    AND, I highly recommend that you consider how writing online is different from writing offline.
    I know this is hard for those of us who grew up writing offline for most of our lives.
    As I like to point out to my audience (artists!), online gravity doesn’t work the same. Things don’t fall down, they fall IN!
    When you write A LOT and have dense paragraphs, most people try to skim to get the good stuff, esp. what answers this core question: What Do I Need To Do?
    Like good fund raising letters, one sentence, maybe two per paragraph works best.
    AND, you want people to take action – so that goes at the top before you try to convince them why they should take action.
    This is critical for people like me who are already your fans and just want to help any way they can. We want to get in, click the right link to take action, and get out.
    After that, if we have time, we’ll read the long copy.

  6. It is critical to understand that nothing in this document is overstated. In fact, after doing much investigation, and having talked to people who have been affected by the FDA and FTC misappropriating the terms “misbranded” and “adulterated”, hearing about the raids at gunpoint, files and records being taken and destroyed, millions of dollars in fines, a corrupt system of “justice”, I concur that any language in any bill that gives the FDA and FTC more power and authority under the guise of misbranded and/or adulterated food, supplements, or milk brings up a red flag and needs thousands of people writing in to Congress in opposition to such a bill or amendment. Take action on this today, as soon as possible. And thank you for bringing this to our attention, ANH!!!

Improperly handled raw milk is responsible for nearly three times more hospitalizations than any other foodborne disease outbreak, making it one of the world’s most dangerous food products.” I grew up on a farm where my grandfather pasteurized his own milk, to keep us safe. The cows & his equipment were as clean as possible, but there had been a long history of disease that stopped with the advent of pasteurization. This amendment seems totally illogical, the risks outweigh any benefit to the extreme. Hence, I disagree with you and will fight to stop this amendment.

  8. Again a seemingly innocent provision has been inserted into a must pass bill that could give the FDA far ranging powers to harrass supplement makers and impose expensive burdens on them.
    i propose that congress should order the FDA to approve all natural substances for medical use that have a GRAS rating. Included should be all bioidentical hormones. In many states doctors can not prescribe bioidentical harmones with out risking loss of license to practice medicine.

  9. Why do we allow our representatives to do such underhanded things like place a bill that has been denied so many times onto another bill that has no association one to the other?.. Don’t they understand what ‘NO’ means? Obviously they don’t else they wouldn’t continually do underhanded things like this.. I think the only way to show them we mean no is to also put them out of business if they keep coming back with it whether it’s written a few words different or if it’s a clone of what they wanted in the first place.. I would love for them to pass a law that once a bill is rejected, it can’t come back for at least five years AND it must be in the same words. I am getting so tired of hearing about these people doing what they want to do while totally ignoring their sworn oaths.. This low life needs to be kicked out of politics altogether and if there were a petition to do just that, I would be one of the first in line to sign it.

  11. This article presupposes that the federal government has the power to regulate farming. This was not the original intent of the constitution. The states need to nullify federal encroachment upon their rights.
    The Commerce Clause (Article 1 Sec. 8 Clause 3) reads: “The Congress shall have power to regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.” The original intent of our founding fathers was to prevent states from restricting or prohibiting commerce, or imposing tariffs upon, neighboring states. But today, Congress can regulate anything that has a “substantial effect” on interstate commerce. All aspects of American life, even your breathing (which emits carbon dioxide and some claim causes global warming) can be regulated under this doctrine.
    Supreme Court Justice Clarence Thomas explained that the early meaning of “commerce” meant selling, buying, and bartering, and not productive activities such as manufacturing or farming, whose products are traded in commerce. The Constitution not only uses the word “commerce” in a narrower sense than our case law might suggest, but using the modern sense of “commerce” creates textual problems; you cannot engage in manufacturing with a foreign nation or Indian Tribe.
    He said: “Yet, despite being well aware that agriculture, manufacturing, and other matters substantially affected commerce, the founding generation did not cede authority over all these activities to Congress. … .” United States v. Lopez, 514 U.S. 549 (1995).
    While the federal government has no powers except those expressly granted, Justice Thomas said “Our case law could be read to reserve to the United States all powers not expressly prohibited by the Constitution.” The Supreme Court has turned the commerce clause on its head, and in the process expanded federal powers to the point it has unlimited power over all aspects of American life.
    “When asked at oral argument if there were any limits to the Commerce Clause,” said Justice Thomas, “the Government was at a loss for words. … Likewise, the principal dissent insists that there are limits, but it cannot muster even one example.”

  14. I told them I ‘m sick of this bill, and they should appose it, and then burn it! I also told them that people need to know how Senator Leahy and his bill will cause harm to farmers and people who seek natural health. I said maybe we need bumper stickers that make that statement, only my letter was a little stronger. I am sick of this bill, and everyone who wants to take away my rights to natural medicines, and why do they want to bother farmers? Do they not like to eat? I asked Senator Leahy what his problem is?   15. How can we stop mandatory homogenization of milk. It is unnatural and bad for our health, fat molecules in milk should not be broken up and suspended in liquid, instead of floating to the top, (like milk fat does in natural, non-homogenized milk). Homogenized milk is like fat being intravenously injected into human body, when the body doesn’t have to work to process it. And the we wonder about obesity! Let’s stop mandatory homogenization of milk!

  17. I cannot understand why Sen. Leahy insists on this amendment – or anything regarding supplements. He has never walked in my shoes!! I need to take supplements as I cannot take “medications” without side effects – some are very serious. I want the freedom to choose my own health care. Other countries embellish alternative care with great success. With the USA it must be for the sake of money “? lobbying?” for the FDA. Why not care about the individuals and not big government? Without us constituents where would Sen. Leahy be. I will not support anyone in congress who opposes my right to choose my own health care.

  18. If this went forward. Could it not be argued that GMO’s that are not labled a such are knowingly and intentionally causing the consumer harm. Or the fact that HFCS is not sugar and does not act like sugar in the body even though tv commercials continue to run and continue to mislead. The FDA is a out of control bureacratic federal agency that kills 350,000 American citizens yearly with their approved drugs and medicines, etc. I.E.: Yaz, Zoloft, Wellbrutin, Advandia, Levaquen, Paxil, Xanax, Accutane,etc. The FDA is a scam and almost a lobbyist group for pharmaceutical, chemical and related industries. They promote and approve synthetic drugs and medicines that kill people. The head of the FDA food board is an ex Monsanto chemical Co. executive.     1. We are just beginning to realize that the FDA, USDA, EPA are just run by lobbyists for drug and chemical companies. We are realizing that conventional “medicine”(pharmaceuticals) are the leading cause of death in the US.
      My family has all had drugs prescribed by reputable doctors that have led to serious illness.

  21. As an animal advocate I do not purchase or drink milk. I drink soy or other milks. The way farm animals are treated is appaling and inhumane. I am fighting to stop the processing of milk altogether. I can’t, in good conscience sign or agree with any thing that does not hold them responsible for the treatment of farm animals.

      I suggest almond or other “milks”, but please stay away from soy for MANY reasons. Even organic soy should be avoided at all costs.

  23. I was raised on un-pasturised milk, as was my sister, and most of the kids at my school. It is nuts to try to claim it is not safe.
    The FDA over-steps what they should be doing, like banning aspartame. Now THAT would be worth-while!

    1. I was raised on unpasteurized milk also. I have been healthy all my life as a result of a good foundation to my health. Pasteurization is needed where good health practices cannot be followed and where urbanization has been so destructive. A simple tuberculin test of the cow is all that is necessary, as well as clean and humane conditions for the animals.

    2. I am a colon cancer survivor. It is beleived by my associates that I got the cancer from Aspartame and the grocery store. But we cured it with a diet change & natural products, thanks to GOD and a designer of natural supplements here in Florida.

  36. The reason this is being hidden inside another piece of legislation is that,
    1. They are trying to get it passed in a covert way without much notice and
    2. If they are going about doing this in this way, they know they are in the wrong, because
    if they brought it out into the light for discussion most Americans would be up in arms.
    The pork that these legislators are accepting in complete disregards for their constituents
    needs, with only the corporate interest in mind, is the very essence of moral corruption and
    cynicism. Why would anyone in their right mind chose to not care about what is healthy
    and safe for themselves, their families and the bigger community at large? It is not
    rational. How can they claim to be “Of the People and By the People”? How hypocritical.
    Please people wake up and vote this greed out of office. Drugs are poisons. That’s a fact.

Where does the FDA get all the resources ….My daughter works for a holistic pharmacy, making many ‘Remedies’ as they must be called, and the FDA is in there all the time trying to shut them down. Despite the many many customers who get so much relief from the many products made there. the FDA ‘investigators’ are constantly terrorizing the place…doing the work of the big Pharma-drug companies …..

  38. I just added this to my request to oppose message : “Pharmaceutical drugs are far more dangerous than natural supplements. Many have deadly side effects and results. Why isn’t the FDA breathing down the necks of those giants or threatening imprisonment? Oh yeah, the FDA works FOR them.
    Will you work FOR the people and secure our right to choose and have the availability to choose without forcing the natural food and supplement providers out of business?
    Everyone knows that special interest groups with big funds are “buying their way” through corrupt politicians. Help save “We the People” and pave the way for what is right.”

    1. The term “corrupt politician” is redundant. They’re all on the take in one fashion or another. This is why we are doomed in this country. We really have very little say when it comes down to it.

  39. Alert: Millions of tax $$$$ are paid out for the FDA’s fight against supplement pruchasing; these practices terroize employees & company CEO’s of supplement & natural reseach medicine.
    Can you imagine they have the freedom of using our tax monies to fight our freedom of choice over our own bodies….why is this not Illegal??????????????
    EVERYONE PLEASE READ THE BOOK ‘FDA: Failure, Deception, Abuse” It will shock some and
    reafirm those that are already aware of the evil activities of the FDA. The book also reaveals whom the FDA is polictically in bed with.
    This fight has been going on for years & as we all know is all about $$$$.
    Jesus Christ wants us to love the sinner & hate the sin; I can’t seem to feel his way, even
    though it is the right thing to do & I want to do His will as I do in most things.

  40. Just a note to tell you I am very disturbed about Sen, Leahy bill about supplements. I am very healthy and believe it is because I take supplements instead if drugs. My husband died because of a drug the doctors gave him. It shut his kidneys down, and the result? He was on dialysis for about 2 yrs. and then couldn’t survive that. They pulled the drug , after it killed about 100 people. If I could hdve ‘do-overs’, I would insist they give him supplements – I believe he would be alive today. I am really bitter about this.

Whether anyone meets these criteria would be determined solely by FDA.”
    Well, if hundreds of thousands of deaths occur each year from FDA-approved medications, then guess who is guilty of such “knowngly and intentionally defrauding or misleading” the public “with conscious or reckless disregard of a risk of death or serious bodily injury”.
    Sounds like the FDA agents themselves can and should be subject to these proposed 10-year jail sentences.
    Small organic farmers and supplement manufacturers surely do not deserve such punishment. Surely the Poison Control Center does not show any deaths from organic foods or from natural supplements!
    Sounds like the Wtiches of Eastwick, all over again. The question is, who is committing the worse crime, the “witch” (who used to heal people with herbs) or the murderer?
