Wisconsin judge goes further and rules that none of us—farmers or consumers—have the right to decide what we have for our own dinner. A state Action Alert!
Last week, Wisconsin judge Patrick J. Fiedler ruled against the property rights of cow owners and their right to consume raw milk from their own cows. Plaintiffs included Galyle Loiselle and Robert Karp, who boarded their cows at Mark and Petra Zinniker’s farm so that they could consume raw milk from them, and the Zinnikers. Here is what the judge said in his own words:
- Plaintiffs [Loiselle, Karp, and the Zinnikers] do not have a fundamental right to own and use a dairy cow or a dairy herd;
- Plaintiffs do not have a fundamental right to consume the milk from their own cow;
- Plaintiffs do not have a fundamental right to board their cow at the farm of a farmer; [and]
- Plaintiffs do not have a fundamental right to produce and consume the foods of their choice.
It would certainly seem that the judge’s ruling violates constitutional rights to property, private contract, and bodily autonomy. After all, is there a more fundamental right than deciding what to eat? (Before this, we thought the FDA’s contempt for freedom of food choice was bad enough!)
Accordingly, Dane County Circuit Court Judge Patrick J. Fiedler’s decision is hereby nominated for our new Tyranny of the Year Award. Every once in a while we’ll nominate a decision or action for the award, and at the end of the year we’ll ask our readers to vote for the one they think is the year’s biggest tyrannical act. Raw milk is natural and healthful; people are 35,000 times more likely to get sick from other FDA-protected foods than from raw milk. One of our ANH staff members recalls milking his cow as a child and drinking the fresh milk. Let’s not allow that to become illegal.

Health and safety is the justification for banning consumption of healthy food – in this case raw milk. But your right to eat known unhealthy fast food chain meals is not under threat.
I have the right to eat what I want – even if it is healthy.
Unless the cows somehow give away the identities of those drinking their milk, how will the judge know it happened? How could he prove it? What will be the penalty for drinking cow’s milk?
Well, since we don’t have the right to eat or consume what we desire, we must not have the right to breathe either!
First of all I am a vegan and oppose animals being owned, enslaved and having no right to their own bodies and lives. Because of this ugly philosophy, huge numbers of animals suffer and die horrifically. But I realize that my point of view is, sadly, still a small minority one, as many people don’t even question the idea that animals are here to serve us instead of live out their own lives in peace and freedom just as we humans naturally want and demand that right for ourselves. So as long as animals are still treated as property and slaves of humans, their “owners” should logically have the “privilege” of consuming their milk, even though it is intended by Nature for animal babies and not for us. Raw milk from family farm cows, whose living conditions are relatively humane, is much better than milk from factory farms that is tainted with bovine growth hormones, antibiotics, other chemicals and impurities, and where the cows’ living conditions are both cruel and squalid.

I like this judge, and wish there were more like him. Dairy cows are continuously made pregnant, as soon as they give birth their calves are taken from them and butchered. Human beings are essentially stealing milk that was meant for another species offspring, how sick is that? A living animal shouldn’t be considered property either.
So, Loiselle, Karp, and the Zinnikers aren’t allowed to drink the milk from their own cow that has been proven by many to be healthier, safer and better than the homogenized and pasteurized milk on the US market but Judge Patrick J. Fiedler’s is allowed to smoke and not only get cancer to himself but the the people around him??? That judge shouldn’t be allowed to rule anymore.
Why isn’t this erroneous ruling being appealed. Second, this judge should be recalled or impeached.

Barbara, Since this is a state bill, only Wisconsin residents have a representative who can vote on the legislation. This would seem to be a judge OVERSTEPPING whatever he thinks his abilities are. The denial of fundamental rights seems totally unconstitutional. Where is my right to life liberty and the pursuit of my happiness. As a child I lived on a dairy farm and we used the milk, made butter and buttermilk, and over many decades only one person got sick and attributed it to a bacteria common in unsafe milk. We milked out cows by hand until we were forced by Carnation to put in a whole new automatic system with refrigeration and large vats that were then directly pumped into their milk trucks as they made their route through the farms in the area. This judge needs to see a proctologist to look for his brain.

And this is freedom? No you cannot chose raw milk, because this will hurt the factory farms, and daries. Their money my freedom, what should come first?
I have had raw milk various times from different sources,cows,goats, and different states… So often there are difficulties in being able to have our food sources be fully organic and local. Of course,to have raw in the US basicall guarantees you do know the animal and it’s health most times, since one can’t get it any other way.
Raw milk from healthy animals is safer because it is free of added chemicals, and offers nutrition that is cooked away in the homogenizing process. Basic science.

It seems to me that judges that abuse their powers as this one has, by blatantly ignoring people’s basic rights should be disbarred.
I am astonished at this judge’s ruling! Has the man forgotten that this is the US and not Russia or some other totalitarian government? People have the God given right to consume the foods of their choice. They also have the right to own farm animals, even if they must board them. I cannot comprehend what this judge was thinking when he stated such a ridiculous opinion but it worries me if this is the way judges are interpreting our laws. Such invasive rulings are an attempt to strike down our Constitutional rights and liberties. We must stand firm against such judges and rulings to preserve our freedoms.
Who gives this man the right to tell people what they can drink or eat. As long as I lived on the farm we drank raw milk from my cousins farm and that was 33yrs. We ate our own beef and chicken that was raised on the farm and it is a lot safer than any of the food we are buying in the store. That guys needs to get a grip. This is the land of the free and we the people have beenliving off the land for a very long time.

As long as nobody forces them to drink raw milk, people should have the right to drink it if they choose to do so. One must have the right to ingest what one wants, freely, and without being forced by someone else. It seems to me that it is one of the fundamental liberties an individual should have. As long as it does no harm to anybody else, it is his business.

I think I figoured out Judge Fiedler’s reasoning. Although not cited in the decision, it sounds like the Judge might have been referring to Wickard v. Filburn, the 1942 decision wherein the US government found that Filburn was growing wheat for his own use and ordered him to destroy his crops and pay a large fine. The justification for this was the Commerce Clause, essentially arguing that growing one’s own food affects interstate commerce and therefore falls under the purview of Federal regulations.
However, both the Wickard case and Grassway Farm v Wisconsin represent the law at its absolute worst. Growing food for personal consumption is so fundamental that our founding fathers must have thought it ridiculous to state the obvious, and so they left it out of the Constitution and the Bill of Rights. Judge Feidler points out in his court rendering a lack of case law supporting these fundamental rights. How many Americans have ever consumed produce from their garden, gone fishing and eaten their catch, hunted for food, gathered food, or pulled an apple off a tree? (The answer is hundreds of millions.) Anyone applying a modicum of common sense would know that millions of people in Wisoncisn and elsewhere grow crops and livestock for their own consumption. Lack of legal precedent supporting Grassway Farm does not make it illegal. People most definitely DO have the fundamental rights listed above.
I hope every citizen of Wisconsin complains loudly to their elected officials to correct this abomination.

Every farmer has the right to consume his own milk from his cows, goats, sheep or what have you. This country was made great by Agriculture.
I grew up drinking milk almost directly from cows (unpasturized). How damaging is that?.Yet they are fine with GMO’s? How crazy is that?

OHow can you legislate what I want to eat or drink? Raw milk is significantly more sae than other foods controlled by the FDA. In fact, illness occurs multiple times more often in FDA controlled foods than in raw milk. Let’s get reaal about the foods we are allowed to eat Genetically modified foods will prove to be the most dangerous type of food of all times. Other countries have proven it and have outlawed them (Most of Europe and South America). Yet our legislatures continue to be bought out by the large Monsantos. My grandfather owned the Maple Grove Dairy just north of Beloit, Wisconsin. He sold the raw milk around town from his horse drawn wagon. His son, (my father) had a cow for our family and I grew up drinking the raw milk. Never, in three generations, did anyone ever get sick from the milk. We thrived! This judge obviously drank pasturized milk as he lacks intelligence.
Judge Patrick J Fiedler does not have a fundamental right to sit on the bench, just because he was elected there does not mean the right is fundamental.
He does not have a fundamental right to dictate what we eat, what we own and how we choose to live our lives.
He does not have a fundamental right to exercise dictatorship in America.
He does have a fundamental right to leave the bench if the above is his predisposition.

I’m sure there is a nice, well paying lobbying job coming to Mr. Fiedler after his stint on the bench. His decrees sound like something from a Kafka novel. You have no rights other than what the state grants you. Are you really speaking to me? Let me consult the state registry to see if you truly exist.
Let’s just pray this does NOT become a precedent for other judges! If it does, soon the government will be telling all of us what we can and can’t eat! I, for one, will continue to eat exactly what I want to eat, including the meat, eggs, and vegetables we produce on our own small farm!
I am not at all surprised by this WI action against raw milk. I grew up on a family farm (we only grew what we used, no commercial outlet). We had a family milk cow and I drank raw milk for the first 5-6 years of my life. The state of MA visited and told us it was illegal to drink our own milk, it had to be pastuerized! To comply, we purchased a pasteurizer and used it. Our cow was well cared for and clean, after all she supplied our family with a vital ingredient for life on the farm. We had real butter, fresh milk, more cream than we could figure out how to use, a good source of organic fertulizer and our cats even got treats of cream once in a while. This action by WI is nothing new, it is just still wrong.

It would seem to me that the judge in this case has been bought off by the dairy industry.in trying to ban someone from consuming his own product. I don’t know how old this judge is,but chances are when he was younger he consumed raw milk. Did he die from drinking raw milk? i think not. It is a ploy to try to control every aspect of our lives by telling us that we do not have any right to take of our own body as we see fit.
Either the Wisconsin judge is senile or he is in someone’s pocket. Apparently he is not familiar with our Constitution or Bill of Rights. Assuming that he can remove fundamental rights should not be tolerated from him or anyone else. WISCONSIN RESIDENTS should come together immediately to remove him from office on grounds of either incompetance, senility, or dishonesty. One of those three should do it. Remember, these people are public servants. When they go over the edge, the PEOPLE WHO ELECTED THEM them need to wake up and remove them from public office – quickly!
By quickly doing so, the people of Wisconsin will notify other potential looney tunes not to get silly ideas like these.

We could use some socialism in this country, considering what a failure crapitalism is – a few people become obscenely wealthy while most people barely get by. This from the richest country in the world; the richest in the history of the world. The top 20% of the population has 85% of the country’s wealth, while the bottom 80% gets a whopping 15%. This is the root of all our problems. Like I said, we could use some socialism in this country.
We do have socialism n this country – for wall street, corporations and other industries. The subsidies they receive from the government is socialism.
You obviousley want a hand out. I am not part of the wealthiest Americans but I dont beleive that they should give part of there wealth to me and I am happy for people who are successful I dont believe they should be punished and have part of their wealth taken away expecially to give it to people who are just looking for a hand out. There are socialist countries for people with your belief system to go to.
There is strong socialism in this country. People who are health conscious feel it most profoundly I think. They make it look as though it is for our protection. Raw milk is unlawful because of food borne illness and death? What about vaccines being responsible for countless cases of brain damage and death? NONE of this is to protect us! It is all about power and control and it makes me angry! What ever happened to life, liberty and the pursuit of happiness?

This is insane. No one has the right to tell us what we can eat or drink all because big business wants to get rid of the farmers that don’t use their products. We still live in a free enterprise economy, not a Communist economy. Find out whose pocket that judge is in. This is frightening and needs to be stopped.

Nice list of “Democratic Socialists” but how exactly are they relevant to this decision? I don’t see any proof, just the blind assertion of a link. I don’t see anything about this judge’s politics. If people have rights to own things, including herds/animals, how does not apply to cows? Maybe this judge is a corporatist who is trying to make all people only consume products processed and sold in supermarkets.
Under Communism you have NO right to own anything not even your body or soul. Communism is exactly where we are being herded. Oh they will not call it Communism; Communitarianism or some such silly nom de jour is being used in the propaganda. What ever they call it it is TOTAL tyranny of the state.
Either the state works for us or we belong to the state. Right now the state is asserting its ownership of us.

Flooded the judge with all facts about the benefit of good, natural nutrition and all the bad of GE, processed foods, or unnecessary medications. In order to be qualified to judge, they support to be educated and understand on the topic that they judged for. Otherwise fired them all.

We need to remember that this is the state in which AFACT (American Farmers for the Advancement and Conservation of Technology) is a producer led organization funded by both farmers (Kansas Dairy Association and Wisconsin Milk Marketing Board) and allied industries (Monsanto, Alta Genetics, Arm and Hammer Animal Nutrition, Fort Dodge Animal Health, Intervet/Schering-Plough Animal Health, Merial, Pfizer Animal Health, Vita Plus, Pioneer Hi-Bred International, Cargill, Accelerated Genetics, Agstar Financial, BouMatic, Eco Lab, Mycogen Seeds, Stewart-Peterson, v-Fluence, Westway Feed Products).
So, it should not be to much of a surprize that the judge is in the pocket of AFACT when his ruling is all about benefitting AFACT and their agenda to posion you with rBST/rBGH (aka Posilac) contaminated milk.

This Wisconsin Judge is violating the Peoples’ right to drink safe milk because there is overwhelming evidence that the rBGH milk is far more dangerous than raw milk. And I see that he stated the word ” foods ” in his ruling saying that we have no fundamental right to consume foods of our choice, violating a much larger right. This judge should be declared a menace to the Public Health and Safety. Disbarment is too good for him. He should be sentenced to a minimum of 10 years in a state or federal prison, then banned from ever being a judge again, in the USA.
The judge in Wisconson is a socialist idiot and the Democrats who are part of the socialist part should go live in a socialist country and leave ours alone!!!
Too bad that those that fear socialism (public schools, police, firefighters, libraries, etc.) don’t understand the term CAPITALISTIC TYRANNY! This ruling is ONLY about protecting the Big Dogs who fear the potential loss of income due to the rise in consumers seeking out healthier alternatives… organic food, farmer’s markets, cow share programs and the like.
The judge ought to be disbarred. Some things belong in Red China, but not in the so-called Land of the Free.

My Grandfather and my Father owned and milked a small herd of dairy cows and our families drank fresh cows milk everyday of our lives while growing up including fresh eggs in homemade eggnog without any adverse effects. The fresh, grass fed milk is sweeter and more delicious than the heavily processed chemical laden, grain fed factory farm milk. Minimally processed is another alternative that still allows for a delicious, sweet flavor. Pittsford Farms in Pittsford, NY and other smaller NY dairies that sell to Lorie’s in Henrietta, NY sell great tasting dairy products! GOD BLESS the small Farmers of America.
